I found out recently that Capital One is still reporting an acount as being open and delinquent after they filed and was granted a default judgement against me in 2006. Currently the Judge is reviewing the documentation I presented because I was never serged. I discovered the default judgement after checking my credit report a year later. I would like to know can they have two open items for the same account on my credit report?


hang on, I dont think that is all that is happening here. The OP said that they are showing the account as "open" and "delinquent". He didnt say they were reporting the judgment. If they took him to court, it most definitely is not an open account anymore, is it? I cant imagine that they could call it open.

To the OP, if Cap One is who sued you, then they are not subject to the FDCPA at all, but you should look into the FCRA, because if they had any knowledge of you not being properly served, then that would mean that they illegally and incorrectly reported the status of this debt on your report. Let us know how you make out with the court and improper service...
