I took out a payday loan for Cashnet USA I havenâ€™t been able to pay it back because of finance problems. lawyer or investigator from a law firm is telling me there submitting the paperwork to Tarrant county sheriff office and they will come and arrest me for defrauding a financial institute. What can I do they wont take payments and I have no money to give right now.

You need to find out who is collecting this and telling you such ridiculous lies. Then report them to your states AG office.

I'm getting calls from nicolia associates from a investigator smith
states they will give me a summons if I don't call back. With current financial situation I can not pay back loan right now. Can i be arrested or wages garnished in Texas?

You can't be arrested for a debt. Keep in mind that CashNetUSA is NOT a payday loan, it is a CSO (Credit Service Organization) and they are perfectly legal in what they charge. What may have happened is they have turned this debt over to a debt collector which is obviously practicing illegal collection practices. As stated above, this needs to be reported to your AG and the FTC. Try to contact CashNetUSA to see if you can make some type of payment arrangements with them.
