Help me with my payday loans (CA)

I am from California and I have the following online payday loans

Big Sky Cash

So here are all the online payday loans I have and I am drowing in phone calls and harrasement. They already called my employer and they want to garnish my wages. It was very embarassing to me. I am negative $1400 in my bank account which $1200 is just in overdraft fees. I am stressing and I don't know what to do. My work and cell phone are ringing off the hook. If anyone has any advice please help


Right off the bat, I see that you have 10 loans listed and you have not paid a dime on 7 of them. Looks like you have quite a few issues as there are a few that are licensed in your state. Also, I notice that you have a loan with Check Into Cash and Loan by Phone. Loan by Phone is the internet division of CIC and for them to give you an advance, you must have given them different information than you did the storefront since they are tied into the same system and would not be able to give you a second loan. The only way around this is if you used your spouses information.

vivianaherr, we are here to help you.. i am unsure about california's laws and which ones are legal or not but someone will be here.
not everyone will judge you here. i would try to work something out with the legal lenders and your bank asap. maybe your bank can take off some of the fees?

So I've been getting harrassing phone calls from Payment Direct. They won't stop calling my supervisor and it embarrasing. I haven't made any payments because I don't have any extra $. I don't know what to do. THis is really taking a toll on me because I have too many online loans.

Viviana, I am also from California and have been where you are at. You have taken the first step towards being PDL free. It's going to take some work, but it can be done.
The first thing you need to do is either fax or write letters to all of your PDL's stating that they may not contact you at work. Simply put, this is a violation of your federal and state rights. And draw these people a picture: if you have no job, noone's getting paid, right? Spell it out for them.
In California, the max any PDL lender can loan to you is $300, including a fee, which is why most places only loan you $255 in cash and bill you for the $45.
You need to sit down and figure out payment plans to pay back what you borrowed and nothing more. This is only fair. I can work with you to tell you which places are licensed and which aren't.
They will try and scare you and say you're going to jail, or will be downloaded, but this is a scare tactic.

Most likely a scare tactic. Is Emerald on line or storefront? The reason this is important is because storefront PDL's are usually licensed to do business in CA and can take you to court. Online ones are not, 99 percent of the time. Storefront PDL's obviously need to be dealt with first.
There is a way to check on the status of Emerald at the California Dept of Corporation's Financial Services database. Go to CA.Gov and click on the Dept of Corporations and follow the steps.

Total hogwash!! They may be referring to a wage assignment. Once you get their contact info email,fax, or mail them this letter. You may also want to send a copy to your HR/payroll dept to cover all basis :wink:
