HELP! Nelson Hirsch & Associates/No Fax Payday Loans

My sister received a call today concerning me and a loan that I took out in 2004. Mrs McDuffy with this collection agency stated that No Fax Payday Loans has a fraud case against me. I call the lady back this afternoon she was very nice, but did inform me that unless I paid $520 fraud charges would be brought against me. I ask twice that this was from 2004 correct and it is now 2009? Why in the world is this still going on? Can they still pursue Fraud against me? This is an internet loan service probably not legal in SC. I did try to call back and ask for Debt Validation, but I have not heard anything yet. Any advice?


Tell them to send you a dunning letter, which is required by the FDCPA. Google it and read about it. I agree, this is probably an illegal lender trying to collect on an illegal loan. What is the name of the original payday lender. Are you located in SC? South Carolina requires internet based pdl's to be licensed by your state. Ask them if they have a licensed to lend in your state, that is the law. Remember, your state law prevails no matter what they say. Also, ask them for their license number, if they refuse to give it to you tell them you will not negotiate until you have it, also tell them you will not even talk to them until you receive a dunning letter as required by the Federal law.

I just received a phone call from a representative that told me the same information - I had a loan in 2004 and they are bring fraud charges against me. I asked why am I just hearing about this and I was told because fraud charges are being brought against you. I asked to speak to a supervisor - Mrs. Robertson and she was very rude and nasty. She would not let me speak and told me that she didn't care what I had to say I only had two options to pay or not to pay. I asked to speak to her supervisor and she stated that she was the supervisor and there was no one else I could speak with. If this company is for real I am filing various complaints against them.

Well for one thing.......to file fraud charges they have to have proof fraud had occured to begin with. If you attempted to pay on the loan, but unforeseen circumstances occured then that is not fraud. A defaulted loan is not fraud, unless you set out in the beginning to take the loan out and not repay. Even then, the burden of proof still falls upon them.

Nelson Hirsch & Associates called my dad's number and told them the same thing, that they were trying to locate me for possible "bank loan fraud" charges in my county. They were hesitant to give the name of the lender. Then they gave not 1 but 2 supposed internet payday loans I had taken out. I googled both of them and could not even find them. I said how can you take me to court if I don't even know what it is? And how can they say they tried to contact me and exhausted all efforts, but they have not any proof of sending certified mail or anything to prove that I even KNEW they were tryign to communicate with me? I have a feeling they are using illegal collection agency tactics, but it's still scary...
