Hi, hoping someone can help advise on this. I defaulted on a loan from Imagine Card. They sold it to Jefferson Capital, and now Simm & Associates has it. They have called numerous times and the few times I have talked with them, I have asked them repeatedly to send me something in the mail. I have received nothing from them. Today I asked the lady again about sending me something in the mail. She confirmed my name, address, and last 4 digits of my social security number. They obviously have my information. She said this was from Jefferson Capital about my Imagine Card. What can I do about a company that doesn't send me any correspondence through the mail???


I only paid on the Imagine Card. I was in the process of negotiating with Jefferson Capital with a new Emblem Mastercard program. They must have never received my application because I didn't hear back from them. Again, I did not pay Jefferson Capital and certainly have never paid ANY money to Simm & Associates without having any paperwork to start with. Also, when I asked her the last time they sent me any paperwork, she said every month ma'm. I asked her what date, and she answered it with, "We are trying to collect on this debt". I live in Michigan. I am not sure about the SOL time line. Do I need to find out the last time I paid on the Imagine Card?

According to RipOffReport, this collector is very bad. They have been sued 38 times in the past 3 years for FDCPA violations.

Personally, if I didn't get the legally required dunning letter, I would assume that the caller is a scam and would act accordingly. File a complaint with the FTC, the FCC, and your State Attorney General. If you ever speak with them again, tell them you have filed complaints because you think that the caller is a scam and not a legitimate business.

A legitimate business has no problem following the law.

I sent them a cease and desist letter for my own peace of mind so they stop calling me (yes, certified with return receipt requested). I hope by the last conversation that I had with them (details above) and combination of the above letter, they won't be calling anymore. If so, I will do as you suggest. Thank you for your help. This board is so helpful!

I did file a complaint with the FTC. Thank you. I will keep you updated. (still haven't received anymore phone calls since the conversation above, but this happened the last time I talked with them too. They leave you alone for about 3 weeks and then start all over again. Glad I sent the C&D letter.)
