Hello, AE is sueing me a arbitration law suit for a unpaid credid card amount. Which has been filed at the county clerks off here in my state of Pa. On checking the filing in the suit says in the doc file attached, a true and correct copy of the total due is attached below in section "A"
There is nothening attached? Its blank.
The lawer is from another state

I do owe AE a balance
I was paying a very very small amount on the bill each month and skipped the last two bills for lack of funds.
They now stopped sending me a bill and now this law suit.
I signed up with AE online web site about a year and half ago
The lawsuit was filed 7 days ago as I have heard nothening from the lawyer or AE about it. I found out about it from local company's that want to help me solve it and made me aware of it in letters I received in the mail. .

It says I have 20 days to respond to it after being served by it?

My main question is I have a small house where I'm the care taker for my 93 year old mother. Its 24/7 taking care of her this last year. Which is why I'm not working. I have sold everything I have owned to do so. The house is all I own.

Being I have not been served yet, can I put the house in my sister name who lives out of state?

Also the arbitration hearing is set in 3 months. No judge, case type contract.

Thank you for your reply on how or what to be aware of regarding this..

Who was the "local" company that offered to help you solve it? I received a similar letter right after being served a summons. I don't know how they find out about summons so soon. I think it is some sort of scam. If you make a payment to them, then they have a voluntary admission that you owe the money, and your checking accoutn number. I searched for the company by name (which I can no longer remember) on this forum, and it seems like they are pretty shady. I don't know about the house. How much are they claiming the debt is?

Yes I think American Express has local companies on there payrole to play nice guy as well.. Think I well just wait for the papers to be delivered.. Go from there.. Interesting is there lawyer that filled the claim is from out of state.. Wonder why they didn't use a local lawyer from this state. Don't they have to show to this arbitration meeting once I deny there claim?
Really can't find any info on arbitration, how it works and such or if it is done over a phone or through email.. Being there is no judge involved.. Thanks

Arbitration is a very bad thing. It is slanted towards the creditors and your chances for a fair resolution are unfortunately slim.

"Americans are sick and tired of a system that so strongly favors big corporations over consumers and in this case robs them of their constitutional right to their day in court." Sen. Russell Feingold, D-Wis said about Arbitration before the 111th Congress, in relation to his "Arbitration Fairness Act" which is an attempt to overturn the Supreme Court's Penn Plaza decision which is what made Arbitration such a lucrative loophole to deny American citizens their Constitutional right to Due Process under the law.

Business Week's article on Arbitration: "Banks vs. Consumers (Guess Who Wins)"
They report that in Calif., only .02% of debtors get the case resolved in their favor based on the merits of the case - at least through the NAF (National Arbitration Forum).

I live in Pennsylvania, so when the arbitration papers are served my question is:

What happens next as far as do we meet somewhere to discuss it or is it done through email or by phone?

The lawyer that filed the papers is from out of state.

On the law suit there is no listing of charges and items amount owed as the lawyer stated there is in section "A" of the suit?

Its like they expect me to agree to a blank check to them..

That depends on the arbitrator (arbi-traitor?!) - you should probably contact them and ask. It's best to be proactive because it looks like they are trying to slide one over on you.

As far as the lawsuit, contact your local county civil court and verify that it is a real lawsuit. Here is a sample summons (it's for New York so it may be slightly different in your area, but it's pretty standard):

Oh, you said you couldn't find any info on the arbitration process. I'm not sure where you looked, but here is a link to the National Arbitration Forum:

Thanks good reading.. Guess I well just wait and see when the papers are served from him to get a better understanding of how they want to handle this.

As far as I'm concerned I was sending them something.. They are the ones that jumped ship in rushing to hang me.. Arbitration hearing is set in 3 months. No judge, case type contract

As I mentioned I wouldn't even know about this if it wasn't someone else that made me aware of it. Maybe that there tactic, have one lawyer post a threating lawsuit.. Then pay to have another nice guy lawyer come along and say .. Hey.. I saw you are being sued. They are both probally working for A.E... Well see..
