Credit Card Debt Lawsuit in SC
Date: Wed, 07/01/2009 - 13:17
Now the plaintiff has sued in another County in SC. This time the plaintiff didn't have the complaint delivered in person and I never received the complaint and didn't answer. They are seeking Summary Judgment on the same debt that the Judge ruled for the case to go to jury trial in a different county.
Does the plaintiff have to follow the ruling of the first judge before pursuing in this new court?
Thanks,

If you have not received any summon and the creditor brings a summary judgment, you can always file a motion to vacate the judgment after the judgment has been passed. The plaintiff can always file a lawsuit against you in any county they want, within your state.
SC, NOT TRUE!!! Must be filed in the county where you reside!!

Yep, in the county where you live. You may wish to file a counter-suit against them and ask for summary judgment in the county to which you do not reside. You will walk with what they are pressing suit for and can in turn pay the debt off with their money or pocket it if it is now out of SOL.
