I was wondering.....If a person is paying, or has made an effort to pay a collection agency, and they refuse the payment and sue, is this legal? What is a person right if they are trying to pay the debt?


Did you negotiate with the collection agency to settle your account for less? If it is so, the creditor may not accept your settlement offer and sue you to the court to recover the entire debt through garnishment. However, even if you want to pay the amount in full, the creditor may sue you if you are delinquent with your payments and you may also be required to reimburse the court fees to the creditor, if they win.

I think what youre asking is if you made a payment and they refused it, is that right? If you made a payment and they refused to accept it, there may be something you can do. Some states have a law that says if a creditor refuses to accept a payment, then the whole debt is thus null and void and they can no longer legally collect on it. Check with the laws in your state to see if thats the case there.

Now, if youre talking about trying to make a payment arrangement, they are under no obligation to accept that. If you say "i can pay you $50 a month" for example, they have every right to tell you no.

If you sent them a payment and they refused it, you NEED to check your laws, because they may have just cancelled the entire debt. Also, it depends on the specifics of your situation--is this collection agency representing the original creditor still? If this was a loan where your payment was $300 a month and you are trying to make a partial payment, they may not accept that.
