Payday-yes loan

OK...We are down to paying off our final payday loan. Getting out of the cycle...however, Payday-loan-yes, also known as ABC payday loan AND also known as fastcash advance (which is what the debits on my account go through as)...anyway, they took the payment out of my account 3 days early. When I called them, they said that though my payday falls on the 5th, they are closed tomorrow and the 5th is a holiday, so they took it out early. They said I should have called them earlier and they could have put the payment through on the 6th (which is my actual payday since the 5th is on a Sunday). I told them that when I took out the loan, I was asked if your payday falls on a weekend, do you get paid the Friday before or the Monday after? I told them ALWAYS the Monday after.

She said she is sorry, but that they always try to tell their customers about their "holiday" policy, but they don't always remember to. I told her that it should be on the contract or the website and that by taking it out early they are causing me overdraft fees and they are causing 3 checks that I did have the money in my account set aside for, to go back, which will incur $38 for each transaction (4 including them taking out the money early, because I don't have enough to cover even that one in there because it wasn't time for it to come out) and then each of the 3 checks will go back and I will have to pay NSF fees at each location when I go to get them...so these 3 checks that I wrote (one for $15, one for $7 and the other for $10) will end up costing me around $70 each in the end. This is going to cause me about $250-300 in fees, hot checks and EMBARRASSMENT...all because they try to tell their customers, but don't always remember.

I told her that my contract with them doesn't indicate a "holiday" policy, it just clearly states that the amount comes out of my account on the 5th and the 20th. I told her that in taking the money out early, they are breeching my contract with them. Am I right? I was angry so I was running my mouth somewhat. Do I have a course of action? The original amount was $300, I have paid $450 and I live in Texas. This was an internet loan...and from reading the threads, it appears that they aren't even licensed in Texas...or the US.

They are NOT a licensed lender. The only thing you owe them is the principal amount you borrowed, no fees and no interest! They are not an easy lender to deal with at all. I'm sorry to tell you this, but there is only one sure way to stop the withdrawals, and that is to close your account. If that isn't an option, then tell the bank to put a hard debit block on your account. I looked at my account today. The bank did not pay it. They sent it back. I think it is because it was an overdraft item. So that is good. I will go to them first thing Monday and put a hard debit block on my account. I don't want to close it if I don't have to because of direct deposit and some items that I have set up to come out automatically (phone, lights, dish, childcare, etc). Thanks for the input. As far as I see, since they are illegal, I have paid them what I owe them...plus some.
