Question about delinquent hospital bill & collections

I have a hospital bill from about almost a year ago. I have been paying a little bit when I can. Today, I get a bill and the amount I owe has all of a sudden increased by $60. I called to speak with them and they said that I am being sued and the $60 is fees associated with their filing the warrant in debt. I was told that even if I can get the funds to pay the bill, they will not remove the fee. Can they legally add this to my bill if the case is not until 8/27 and a judge has not awarded them anything as of yet? As of today, I have not been served and my case is not showing up on the court's website yet.


The creditor need to pay the court fees and other cost if they file a lawsuit against you. However, if the creditor wins and bring judgment against you to recover the debt, you need to reimburse the court fees and the attorney charges.
If you have already been issued a summon, you should file an answer to the summon within 30 days.

A relative is going to give me the money to pay the bill off prior to the supposed 8/27 court date. I have not been served and there is nothing showing under my name on the court docket. I am just wondering if they can legally charge me this $60 without the judge awarding them legal cost? When I told the lady that I would pay the entire bill next week, she said it didn't matter & the $60 would not be removed.
