Has anyone had any dealings with the "mediator" company called WNYC? They work for several creditors, but First Bank of Delaware left my sister a message that they were going to serve me paper on Monday between 10-12. I called the 800# and he told me that I was in serious trouble for check fraud on a closed bank account and will have to go to court if I am served these papers. A $400 loan turned into $9000 with all the fees. I have to come up with $2442 by TODAY or they will proceed with serving the papers. He also said that if I cannot pay them that large amount to tell them what I can pay, then he will offer that to their client and see if they accept. I am absoultely sick to the stomach about this. I do not have that kind of money and if I did, I would not have borrowed. Is this real or a scar tactic? Regardless I need to pay them back, but I wasn't sure if WNYC was a real mediating company. Any help would be appreciated.


Can you tell me what is the worst than can happen? Will they deliver a summons to my sister's house? I was thinking about this and why would they deliver it there and not my house? Also, They told me it was for Cash Net. I can find no informaiton on Cash Net. I do have an account with Cash Net USA but they told me they gave my account to AIS.

AIS is another collection agency, make them all validate the debt to see who really has it. They can not serve a summons to anyone else but the defendant or registered agent if you were a business. You need to send them a letter stating they are in 1 by threatening you with legal actions and other things outlined in the FDCPA laws. You have to take a proactive approach to these type of actions. I would also get a copy of your credit report and see whats on there that will give you a good idea of the damage they are doing.

I just called WNYC as I promised them. I got his voicemail and left him a message that I needed to get something to validate the debt. We will see if he calls me back. I am just more concerend about them delivering papers. My sister got the call and is afraid that they can do something to her. She called them as well and they would not tell her anything, but they did tell her when she called them last night that my "summons" was stopped as of 5:00 yesterday. I have no idea what that means. When I spoke to them around 7:00 last night, they told me they would put a 24 hour hold on it. I had to tell them how much I could pay. I am really baffled by this collection agency.

You may be misinformed about the process. You must send them a letter telling them to validate the debt. You can find links and samples anywhere. You must send that certified mail ONLY with return receipt or delivery confirmation attached. Do not call these people EVER. You sound a little bothered by them. Nothing happens over night no matter what they scare you with, except they can get your validation overnight, UPS etc. Slow down don't stress and don't let them know you are stressed. Enjoy your weekend and tackle this head on Monday. Write your validation letter plue your 1 letter. Send them both on Monday. We have all been in your spot or are there now, but DO NOT let them stress you.

sorry, I forgot to sign in both times I responded. I am the "guest". I will write them a letter. However, I don't have their address. Can that be found on their website? I am not sure if they are licensed or not in my state. I live in Pennsylvania. Thank you everyone who responded. I was really stressed over this and I have a had heart. :shock:

I had the same people calling me a threatening me .. I sent them some payments and told them I need a letter USPS as per my attorney .. they stopped calling me since but now turned it over to another co. called GIOVE law office... this lady has no clue what she is talking abou tshe keeps putting me on hold and saying she needs to ask the attorney ... I do not trust these are the right people that are the original loan and they are just collectiong money form me I payed the 120.00 last week now they want another 195.00

I sent WNYC a registered letter today as well as emailed it to them, the FTC and the New York State Attorney General. They actually replied to my email. This is what they sent to me via email on their letterhead. They did not respond to the fact that I needed validation of the account.

Dear Dina,

We will Cease and Desist all communication. If you wish to resolve your account you have 10 days in which to do so before your account will be forwarded out of our office.

This is a good cause, they are saying they can not validate the debt and they are going to sell it. Keep ALL transactions from them and make sure if another CA contacts you, you do the same thing. It all has to be done by certified letter as well. This debt should be deleted from your credit report as well. Great job on your first successful fight. Keep it up. Also do not contact them, watch for a sister company or affilated company sending you notice. If they do they are in violation for not validating the debt. Again great work.

Thanks. I know I owe the money, but the way these people go about things, it's absolutely ridiculous. I emailed them after I received that C&D letter from them about why they didn't validate, and they never responded. Thanks to everyone for their help with this. We have to stop these people. I copied the NY State Attorney General on the letter as well. I will tell you though, they did scare me at first, I was a wreck, then when is started to look into their company, all fell in to place. They first told me they were representing First Bank of Delaware then they mentioned "CashNet". Not CashNet USA, this is another place that I have no recollection of. I highly doubt First Bank of Delaware deals with illegal pdl's. I believe they misrepresented themselves as defending FB of D.

I'm glad that you filed complaints, if more people would file complaints it may encourage state and federal agencies to put a stop or make it more difficult for these illegal lenders to get away with extortion, and that's exactly what it is when a lender calls and makes false threats that scare people out of their wits.
