Fighting Wage Garnishment

Has anyone successfully fought a wage garnishment? I live in MS and went to the circuit clerk yesterday to see if I could file a slow pay motion. They said the only motion I could file was a "motion to stay" which is where I take all my bills before a judge and explain why I can't afford the garnishment.

I tried contacting the attorney today and the lady I spoke with was rude basically saying I missed payments so there was nothing they could do.

This is a garnishment from a medical bill. I have more surgery coming up and I can't afford this! I was going to sent a certified letter to this attorney again asking for a settlement instead of garnishment. And then go to court.

I don't want to file medical bankruptcy, because then I'm scared my doctors won't see me. What should I do?


I had a garnishment lifted but it was because I wasn't served properly, therefore I filed a motion to vacate the judgment. I am not certain about your situation but I once owed a huge medical bill but I called the hospital and ask them if I could fill out an application for a hardship payment plan, they sent me the paperwork, I filled it out and do to the fact that I made very little money at the time they completely forgave my bill.
