can i keep my house if i file bankruptcy. i bought house 1 year ago i have about 1500 in equitity .i make 5400 a month with 80000 in cc dept. i need help ?


Yes. You can keep your house. You are allowed so much in exemptions. A Chapter 7 would be your best bet. Whatever you do don't continue to use those cards. If you haven't used them in a while you should be ok.

Filing in a short period from using the cards raises red flags from the creditor. They could appear and contest the discharge.

Don't transfer any titles or deeds or property to anyone either. You should reaffirm any debts, especially if you have car loans, appliance loans, etc..mainly secured property, if you want to keep it.

Also, stay current on your mortgage!

i haven't used cc in 3-4 months but then again most are at there limit , and late to begin with. don't have any car loans . i have student loans for 160.00 per month. my motrtgage is on time. i do have rental house that is late 2 months behind i dont care if i lose that, such a pain to have couldn't sell i rented out. is it best to file with the house or let it forclouse. either way i'll have bad credit.

i have the most 15000 in equity by the standards but there is no way i could sell the house for that . i paid 70000 for the house owe 55000 bought the house in 1994 there is no way the house would sell for even 60000 now with the way market is today. What did you mean by you hope not alot of equity is in the house.
