So in a previous post I mentioned that I am trying to pay off my debts on my own without help.

So far things have seemed to be going ok, when we hit a snag.

One of my CC is an Applied Bank VISA that was sent to Allstate Financial services for credit collection. Three months ago they "worked" out a plan with me to get us on a hardship program and talked about how much I might be able to put down on the card in "good faith". I told them, point blank, that I would try to come up with $120 but that I could not commit until my husband was paid and we knew we had the money. I was very clear that they were NOT to auto-deduct money out of my account.

A few weeks later, an automated check for $120 for Allstate showed up on my account. I was LIVID!!!! I called and had to wait for a day and a half before I was able to get a supervisor who told me that the financial department had seen the amount and run the numbers without checking the notes on my account specifying that they were NOT to auto-deduct. They were all apologies but stated that they could not reverse the payment. I threatened to shut down my checking account and they promised that it would not happen again. And at that point, we worked out a new Financial Hardship program that would allow me to pay $66 a month. The agreement was that I was to pay the money before the 15th, and again, I made it EXTREMELY clear they were not to auto-deduct again.

This morning I was checking my account, when low and behold, there is an automated check for $66. A check I did not authorize. A check that was cashed on my account 5 days before the set payment date. Of course I did not find it until their office was closed, so I am having to wait till Monday to call.

Naturally, I AM PISSED!!!! Not only are they taking money from my account I did not authorize, but I realized today, after taking a closer look at my online account balance, that even though they took $120 from me last month, only $104 made it to Applied towards payment. Again, this month, they took out $66 but only $50 made it to Applied. NO WHERE, AT NO TIME, in ANYTHING they told me did they state they would be taking a fee and I do not see how this is legal!!!!!! And on top of everything else, even though THEY are auto-deducting money on THEIR set date, they are charging ME late fees!!!!! How is this legal?!?!?!?!?

Could someone please give me a clue as to what I should do from here, other than just closing or freezing my account, which I am in talks with my bank to do?............


Unless you got an agreement in writing or recorded the conversation detailing the arrangement (and you could legally admit it to Evidence in civil court), there isn't too much you can really do except to close your account and consider it a lesson learned.

Send them a Debt Validation letter (Dispute) and on that letter also ask them to defend their charges you mentioned.

Actually there may be something you can do. First open a fraud case with your bank. The simple fact is you never authorized them to dip into your account. That is fraud. You can pursue them for fraud but it will take some doing. They would have to prove that you gave them authorization, which would be hard for them to do if you never gave them authorization to begin with.

Talk to your bank, get that account closed and a new one open but let your bank know you want to pursue this theft of your money. They will best know what to do.

Also, when you set up a payment arrangement..get it in writing! That is paramount! because without it they can just decide how much of your payment gets applied. mIf it is in writing they have to abide by it, if you pay $50 bucks a month towards the debt and it is in writing, then not one red cent of that can be for anything else.

Always get it in writing. I can't stress this enough. If they refuse to put it in writing then you refuse to pay. Even if they sue you, even the judge would ask them why they wouldn't put it in writing. After all, if they had every intention of honoring the agreement, they would have no reason to not put it in writing. Something to think about.

I am so frustrated!!!

I called the company and they were completely inept! They made me wait and call back today, and when I did, the "supervisor" I am dealing with is having ME get the information from my bank as to what date the check was written for. They are claiming that the bank cashed the check early but my bank sent me a copy of the check, it was dated for the 10th. So Allstate is lying. Again. On top of this, when I demanded to know why only $104 and $50 was being applied instead of the $120 and $66, he basically called me a liar and told me that I was wrong and that they paid Applied the full amount I had given them!!

I tried calling Applied and they told me that they are not allowed to do anything with me on the account, they refused to work with me personally but they did tell me that a) Only $104 and $50 was put on the account, b) they are charging me the Late fee because they lump the late/overlimit together and I will continue to get charged even though the hardship program was supposed to help with this and c) (and this one REALLY pisses me off), Allstate charges a $16 processing fee for every payment.

?!?!?!?!?!?!?

So Applied knows they do this but a freaking supervisor cannot tell me that they charge a $16 fee and calls me a liar to boot????

At this point I am going to have to open a new account but I don't know what to do at this point. I am paying the money I can afford, so on their 'Program' to help me pay it off, I am actually only paying off $18 a month.

I don't know what to do.

I put a stop on my bank account and did exactly what was suggested above. I am writing the attorney general to have them investigated. These guys are crooks, they pretend that the person that you talked to and set up the arrangement with is no longer at the company. Fortunately I have a letter with the payment arrangments on it. I am pursuing the fraud and the unautorized payment.

Great. Best defense is to go after them for their violations. They seem to think that the people they talk to are idiots. If they violated their written arrangements, then they would seem to have no defense. Like Chrys said early deposit of a check or instrument is and FDCPA violation. That could be worth $1000 plus lawyers fees and court costs.

Go get 'em.

att at law.. i would love to get a hold of you not sure how to go about registering and all that i do have an account with them and have the employee name that was rude and stated if I missed one payment my file would be sent to court house for further collection activity, i wanted one payment stopped because I did not have money left over, and i got a lecture on being responsible and should pay my bills.... he was rude, threating and miserable.... i asked what further collection was and he said i would have to wait to find out, yes and 16 a month is very uncalled for a check fee...

This Greg Anthony is most unprofessional and I hope Allstate realizes that he is actually costing them money. I say this because I actually have the money to pay and have offered to pay in one lump sum. All I asked him was to send me proof of the debt in writing and an address to send a cashier's check. He says that I'm broke and am just trying to buy time and I wasted 45 minutes with him listening to threats, name-calling, insults, etc. And in the end he said he would NOT send anything in mail. So, Allstate can count at least MY unpaid account due to the ridiculous antics of this clown, Greg Anthony.

I am having to close my account out today after having to file the 2nd fraud charge with my bank and the 4th wrong amount that they have sent through on my account and numerous wrong dates!!! Send me your email address and I will be more than happy to email you!

iT HAPPENS TO ME TOO I AUTHORIZED A WITHDRAW FOR 200 AND WHEN I CHECK THE BANK THEY TOOKED 416.00 TRY TO CALL AND NOT LUCK, I CALL THE BANK TO STOP BUT WITH NO LUCK , THE FOLLOWING MONTH THEY TOOKED ANOTHER 416 THIS TIME I WAS ABLE TO REVERSE THE WITHDRAW AND CLOSE THE ACCOOUNT,
I TRY TO CALL BACK TO ALLSTATE AND I WAS NEVER ABLE TO GET IN TOUCH WITH THE PERSON WHO I MADE THE ARRENGMENT FOR THE 200 NOW I DON'T CARE BAOUT THEM THEY ARE A BUNCH OF CROOKS I WILL SUGGEST YOU TO GO TO YOUR BANK AND CLOSED THE ACCOUNT

Do not give them anything---they will not sue you---i used to work for them--crooks
illegal operations----some names to be aware of: Karen-marie-troy-doug //// these are just a few------they are operating in the basement of an employees basement in nova scotia canada cause couldn't pay the rent for the old building!
Numerous employees fighting for $$$ owed to them-----be careful---if they have your bank info they will wipe your account clean

and tell them that were going to sue them. Also it was a most to say we were private investigators on fraud checks or on pay day loans... Their main paper is golds gym they charge triple the amount that comes into the agency... Also they collect on accounts from different clients that they no longer have contracts with... their collecting in a office that no one is to know were its at... do not give your check info to them .

Im furious! I paid what was due when i cancelled an early membership with golds gym. The last four months theyve been charging me an additional $66, i filed a claim and i also stopped payment. The claim takes a while for investigation to go through and the stopped payment somehow didnt process so swift funds/all state financial (whoever they are) continued to take money from my account. I just had to close my debit card and file another claim for a total of four months. That is money i dont have especially because i pay bills and my college necessities. This is rediculous, two of my sisters work for chase bank and have told me that numerous people have come in complaining that this collection agency is taking unauthorized money from their accounts. something needs to be done! Believe me im definitely doing my part!

If this helped, I worked for them in april and may of this year. I walked away because it seemed fishy.. Doug "Diamond" is just an alias. his real name is Douglas Joseph DODMAN. (you can find him on facebook! =] ) He is running a shabby "call center" out of his three bedroom basement apartment.. on Spruce St in Halifax Nova Scotia. Just so everyone knows.. these people are drug addicts, bad parents... Low lives. And to be very clear, nothing about this is legal, they don't make anyone do training. Just read verbatim what he's given you. many people including myself still have the program on their PERSONAL computers with access to private information such as client addresses, birthdates, and socials. I have been in the program for the last week changing EVERY account to paid.. :rolleyes::twisted: I was ripped off over $500.. Never received ONE pay..! I know one thing.. If you want to spend a little time pissing Doug off.. you can call 619 365 4150 just call and hang up at all hours of the day and night.. its his work phone in his living room.. given time differences I'd be pretty annoyed. BLOCK YOUR NUMBER. He has caller ID
