I am so scared

I live in az. I have 6 pdls. 2 of them are only a week old. I got them only because i had no choice. I had to fly to MS. for my grand mothers funeral. I needed the money for a plane ticket. Anyway, my hours have been cut at work and i cant even afford to pay intrest on the pdls. (or rent either). My mom told me if i would file bankruptcy on all of this plus there is alot of other debt to, she would pay for it. God bless her. Can I file on my pdls? i am scared i wont be able to especially on the 2 new ones since they are not even do yet. i meet with the lawyer on thursday, the same day the other pdls are due. Please any advise would be helpful. ps all loans are storefronts


They wouldn't ever be able to collect but I am willing to bet they wouldn't stop harassing you (the unlicensed ones) even after you filed. There are many unlicensed lenders who are located overseas (and some who aren't but still unlicensed), therefore they didn't follow the law to begin with and probably never will. Perhaps it might be a good idea to find out who is and isn't licensed lenders (pdl's), at least then you have a heads up that they may harass you anyway.

All the pdls are storefront, they are legal, do you think i will have a problem filing on the 2 that are only a week old. I did not get them knowing i would be filing bankruptcy. I had to fly home for a funeral. that is when my mom told me she would pay for the bankruptcy. I didnt commit fraud with them. I am just scared they will say i did. Also, once i retain a lawyer i wont have to deall with the harrassing right? since they are legal companies, the have to follow the law and contact the lawyer right?

that is INCORRECT that debts have to be in default before you can file bk! There are time limits and amounts on credit card debt before you can file on them and there may be on pdl's as well but I'm not sure. You may want to check in the BK forum for info. Wosrt case scenario is you file on everything else and then (the court/your lawyer) would arrange payments for you on the other. Don't worry it will be okay-been there, done that, got the t-shirt!:)

If you have commited to filing, then file. Maybe 1 out of 100 legal lenders will challenge the filing, but I would not worry about it. In fact, we had an atty in one area that would direct his clients to get a PDL for the intial payment of his fee and he would include the loan in the BK. Real ethical!!

The most important thing to remember is that if you are filing BK, then include EVERYTHING!! Do not keep on item or two out because you feel guilty. Whether you file on everything or just a few items, it looks the same on your credit report!

True-include everything, you don't have to worry about what to include and what not to include before you file. After you file its then up to the pdl to object and challenge you. Most places are'nt going to bother doing that over a couple of hundred dollars. If they do challange and win thats when the court and/or your lawyer would set up the payments for that individual debt.
