Hi, I'm stuck in payday loan hell. I currently have 7 loans.... many of us have done it.... take out a new loan to pay off another and then get socked with hundreds of $ of NSF fees because these companies just dont quit!

I went to my bank manager in tears the other day not knowing what to do because I was working tons of hours of overtime and there was no way to get ahead. My bank closed my checking account and debit cards and waived over $700 of NSF fees for me! They were wonderful. Now I'm trying to decide what is the next step.

Here are some of the companies I have used..
Fast Cash Preferred...Ameriloan....500 Fast Cash....Everett Cash Advance....Cash Direct Express .....Upfront Payday... Zip19....

I have been doing tons of research online trying to figure out what to do and have been speaking with a real nice lady at a Pay Day Loan Help company but there fees seem pretty high and can they guarantee that the harassing phone calls stop?

I'm just looking for advice here..... what have others done?

Another question, I keep reading about some of these pay day loan companies are not legal in certain states. I'm still unclear on this. Does that mean the company's address is in that state and they are illegal, but what if you live in another state and you use them? Probably a dumb question, but I need to ask anyway.....

Any advice would be VERY welcome.

Yes, a payday lender is legal only if it is licensed in your state, else not. If they are illegal, you need to pay them only the principle amount borrowed and not the interest charges. As far as I know, Zip19, Upfront Cash,500 Fast Cash, and Ameriloan are illegal.

Yes if they are illegal that means that are not licensed to lend. Most of the illegal lenders are not even in the US.

We do need to know what state you are in as different states have different laws (although the lenders from overseas are illegal everywhere).

I had/have CashDirectExpress and there seems to be some debate over if they are licensed or not. Their parent company if GECC who is licensed. Although CFSA says they have to have thier own license they can't go by the parent companies licensing. They do have some illegal practices so I have been treating them as though they are illegal so far.

Yes you can do this yourself-especially if the majority are illegal which it looks like they may well be. It just takes a little time in researching is all.

You need to send a letter to each of the PDL companies revoking ach transaction agreements. Tell them your bank has closed your account. Tell them you wish to enter into an extended payment plan (EPP). Once you enter into an EPP this stops all the roll over fees.

Ask for their address in which to mail payment (money order, moneygram etc.) Do NOT give them any new account info if you open a new checking account.

If you want to stop the harassing phone calls or threats send the PDL companies a "cease & disist" letter:
