My mother in law called me in April and told me that someone had called my sister in law's boyfriend and was demanding information on where I was and how he could contact me. He told me that it was urgent because I was being investigated for fraud.

Okay. I call, take a settlement, and pay the debt. Then I am cleaning my office out and I find a collection agency that owned it before this one, and the balance was 473.00 I paid a 30% settlement to them for 617.95. I have paid off my entire account with them, can I do anything.


Most of these collection agencies threaten you so that you contact them immediately and repay the money out of fear. But the fact is that most of these CAs cannot validate the debt and so they cannot collect it illegally and adopt such practices. Did you have the settlement agreement in writing?

Unfortunately there is not much you can do. I am not sure by your post, but it sounds like the company that you settled with was claiming that you owed around 1900 and you settled that for 30%. Then you found an old collection letter for 473. How old was the first letter? If it was years ago, they could have added fees, although that seems like much more than they should of. Unfortunately your only recourse, if you have one, would be to sue and possibly allege fraud if they grossly overstated the balance. The problem is, it would cost you more than it is worth to even fight it, and unfortunately it is unlikely that you will win, since you didn't pay the 1900. You paid 617. So there isn't much you can or should do.

Vandenberg Chase and Associates made initial contact with my sister in laws boyfriend. He demanded that my sister in laws boyfriend to give him information of my whereabouts because I was being investigated for fraud. He said I wrote bad checks, and was being investigated. So when he called me, I called them and within 24 hours I contacted them. I thought that they were a law office. I mean Vandenberg Chase and Associates, fraud investigation, serious legal trouble.

I already suffer from a military veterans anxiety problem. And this scared the crap out of me. Not too mention that I have children that rely on me now. Then when I was cleaning my office, and found a collection for the same account. I called them. He assured me that since his company was a firm, they would not be allowed to add fees that were breaking the law. I shouldn't expect to have a loan that doesn't incur any fees or interest.

OOPS

anyways, I called the PDL company that the debt originated with. They appointed it to a collection agency. This is my number one collection agency which can follow anything that I signed to. This collection company DID NOT add fees or interest. She told me that their company just doesn't do that. They sold that account to Nirvana trading for 473.00 in November 2008. She also indicated that there had been no update on any payment to this said account.

I called the number for Nirvana Trading, and low and behold it was VCA. I decided to talk to them, and got through to Steve. He wondered why I was calling because my account was paid in full. I have all the money information, the first collection invoice. They lied to me in order for me to go into agreement with them, and making me think that I was still under contract with the PDL Company,
