Hi All,

Move this if I have the wrong spot :-) I'm trying to figure out who reaged my debt. In May 2009 I was contacted by Zenith about an old CapOne debt. It is 4 years beyond SOL. I did a DV and received some printout of some odd figures and no where did my name show-up. Of course I figured that they are trying to checkmate me because they said in the accompanying letter they have satisfied my DV and to contact them immed. about payment. yeah, I'll do that - NOT

I just looked at my Experian today and it seems the Charge-Off status has been changed to "transferred, closed, purchased by another lender" THe original charge-off date is 4/2004. TL is now showing Charge Off as pf April 2009, April 2004.

Not to mention I see in the 24 month payment history all NDs but for March, April 2009 is shows CO and for May, it shows OK

OK????!!! No payments have been made ever, no offers of payment, I have NEVER even spoken with anyone about this! I had nothing stated in DV that this was my debt either - standard DV with the 10 demands for proof, etc...

Suddenly, the drop-off date has disappeared when it was 11/2010.

Is this a reaging of the debt? If so, did CapOne o it or Zenith. No TLs for Zenith (so far!)

I'm going to dispute with Experian that this is a reaging and then send both CapOne and Zenith a nasty letter with threats about lawsuits for reaging the debt.

Is this the correct way to go about this?

Do not confuse SOL with FCRA reporting time limits. SOL is state dependent. Per the FCRA Zenith would have to provide the same Date of First Default as Crap1 which would be no more than 7 years + 180 days from the DOFD. If the original charge off was 4/04 then the account likely went delinquent in 11/03. As far as the TL showing Charge Off as of 4/09, that would be accurate. CO is an event as well as a status. Once the account has been CO'd, that status can remain until the tradeline drops after 7.5 years. No re-aging that I can see.
