I know I should send them a DV letter but should I sent a Cand D letter as well? How should I handle from here?

No, they aren't licensed to lend to your state residents, therefore, the CA they are sending after you is most likely a bottom feeder. If I were you, I would inform them the federal law states a collection agency has 5 days after their first initial contact with the debtor to send them via mail a dunning letter, therefore you can't do anything or even as much as acknowledge this debt until you receive one. If they refuse, then tell them you will see them in court. Please make notes of when they called, who you spoke with, what was said, the date and time, and their phone number. This way, when you file a complaint against them for unfair collection practices you will have a very organized diary of information. :)

I'm not sure if they have called me or not to be honest with you. I really don't answer the phone if it's a 1-800 and will call them back if it's a legit message. *I find this is the best way to avoid harrasing phone calls from illegal PDLs* They did send me something in the mail...what exactly is a dunning letter?

Dunning Letter: Written notification of the pending amounts, meant to prod past-due customers to make a payment. Collection letters are sent usually one after another, with the tone and language getting more direct with each successive letter, until at least some payment is received. An effective letter of collection achieves its purpose without destroying the customers' goodwill that was painstakingly acquired over the years. Also called dunning letter.
