So I got a call today from this company HBZ Financial telling me if I didn't pay $500 on an old pdl I had from a year ago that they were going to file charges against me for fraud (lots of legal jargon that is really scary). I asked for an address when I can send documentation of a payment agreement I entered into with payday2go and fufilled (not actually true, I wanted to see what they would say) and they said "get it around and call us back" and I said "are you refusing to give me your address?" and they kept repeating themselves. Originally they were going to give me 5 days, but then the guy called back (5 times until I answered) and told me he spoke with his "clients" and they will only give me until Thursday.
I did some research to see if Payday2go is licensed in CO (where I live) and they don't even exist anymore.
What is anyone's suggestion for fighting these SOBs? I have tried debt validation with the old company that bought it and they ignored it and it seems they then sold it...they are calling my family in Michigan who is dealing with a health crisis (I know that sounds totally fake, but it's true, my mom is in the hospital and I don't really need to stress them out more than they already are).
Here are the vital stats: The original loan was $300 of which I paid $300 back at that point I lost my job and called PD2G and made an arrangement to pay 1 more $75 payment (with great protest they took the deal because they knew they couldn't get more money from me being out of work), but they never drafted my account for the money. I didn't hear from them for 3 months, they never actually tried to draft my account again but they called and emailed insecently. I ignored until debt was sold and then requested debt validation. Never heard from that company again. Now I have been getting phone calls from HZB Financial for months (persistent lil buggers). They finally left me the threatening phone message today. To get my contact info (which had changed) they called my father and told him that they believed I was the victim of identity theft and they needed to contact me ASAP so they could clear this up.

A creditor/CA cannot file charges for fraud against you if you default with your payments. They can at the most sue you and bring judgment against you to recover the debt through garnishment.
Again, a creditor cannot recover the debt through garnishment unless they validate it. Moreover, if the payday lender is not licensed in your state, you are liable to pay them only the principle amount borrowed and not the interest and other finance charges.
