Needing help in Iowa

I got myself into a jam with internet payday loans. I needed cash for house payment food and necessities as husband was laid off and bills were piling up along with disconnect notices and all that. Anyways we started with one loan and still were behind and had NSF charges so again anohter loan to cover things and a few more after that. Now we are paying over 800 a month in PDL and not able to pay our NEEDED BILLS. Im overly stressed and worried about what will happen. I am not against paying these places back but would like to lower the payments or something so that i can afford my bills and to put some REAL groceries in my house. I read that PDL are illegal in Iowa what does that mean? Do I have any rights anything I Can do? I cna close my account but i have checks out what happens to those? I don't want those people to think that i am unwilling to pay tehm because i need to close my account to avoid the pdl people from taking everything i have. ANy advice is greatly appreciated. In my opinion....the best thing for you is to close your account and secure your funds. You are dealing with illegal lenders. Set up an extended payment plan to pay them the principal amount borrowed only (no interest, no fees).

I am going to go to the bank in the morning and close my account. the National Payday debited two payments today and overdrafted my account cauasing house payment and car payment to bounce i talked to teh bank and they had him sign a paper to reject the payment and give us that money back. THey suggested i close the account and open a new one. I wasn't sure of all this stuff when i talked to them and had chose not to close it today but will be doing it tomorrow.

I have reviewed my bank statements and found out when pay day loans started and what i have paid on them thus far.
500 fast cash borrowed 500.00 have since paid 715.00
United Cash borrowed 300.00 have since paid 500.00
National payday we till owe them as we have only made 2 62.50 payments as our bank kicked out the two payments today of 237 each. so we owe them 275

I am closing it today and hten going to send letters do you have a link ot sample letters? or suggestions on what to put into the letters? This has relieved so much stress knowing there is a way to stop this and not have to loose everything i have. do i need to call the iowa attorney general? i thought i read somewhere that i sh ould but i don't remmeber what for. All this has got my mind in a jumble

Yes, you should file complaints with your state AG, and FTC.

Here is a sample proposal letter. Just taylor it to fit your situation.

I have closed my account with the XXXXXX to protect my interest in this matter, per instructions from The _____ Department of Finance. I also revoke any and all wage assignments I may or may not have signed with your company, I no longer authorize you, your company, or your affiliates to attach any part of my wages or contact my employer for your collection purposes. I have notified my employer about this matter so any attempts to do so on your part will be rejected.

I demand that any contact be made through US Postal mail or email only. I will need everything in writing to keep accurate records of all communication as per instruction from my Attorney General's Office.
I prohibit you or your affiliates to contact me via telephone at my place of employment or my home

The legal amount that could have been charged to my loan is the principal amount, even IF your Internet pay day loan were legal anywhere in the U.S.. I am willing to pay the principle amount of the loan only, however, this is only if you provide me with a physical address where I can send payments.

I must also inform you that I will be filing complaints with the Better Business Bureau, the Federal Trade Commission, and the ____ Attorney General's Office.

I expect a response from your company no later than 5 days from the above date regarding this matter. This response may only come via US Postal mail or email. No telephone contact is permitted.

thanks i called my bank and let them know these things were illegal and that i was waiting on the iowa AG and the Iowa banking division people to call me as the guy wasn't in the office. THey got my two payments back and are freezing my account they are going to close it this afternoon and open a new one and then they will manually put through the checks we approve. i am soo relieved and they are being really nice. They do not know what a hard block is or an ach block but did assure me that once it is closed they will not let anything not okay by us thru. I asked to get this in writing she said no problem sooo hoping this will be taken care of
