Can some one please let me know who to contact regarding this company? They keep calling me saying I have an outstanding pay day loan with Platinum Services from April. I do not have any paperwork from them and when I ask them to email me some proof, I have been told twice they would send it and I have not received anything from them yet.
They are threatening me with garnishing my wages and notifying my employer. 3 weeks ago I set up a payment plan to come out of my savings but thank God nothing has happened with that. Now they are calling me and harassing me again.
Any help will be greatly appreciated.

Bonnie Karels,

Welcome to forums :D

First Credit Services, Inc is a collection agency and has branch offices at New York, Illinois, Florida and New Jersey according to BBB. You can search BBB's database and get their contact details.

Strongly tell them that you would like to see some paper documents first. Meanwhile send the DV letter through CMRRR. You can attach one paragraph in the letter if you don't want to be contacted over phone. They cannot call you anymore once they receive this letter.

Or you can contact your original lender and check if they are willing to settle the account. Offer them a lump sum amount if possible, or propose a payment plan. If they agree to work with you, request them to take out your account from collection agency.

I don't think collection agency can garnish your wage. However your lender can withhold a particular part of your salary if you have signed a voluntary wage assignment during the loan agreement. Go through the link below and review how wage garnishment takes place-

You need to make sure that the lender or collection agency is calling you for a debt that is legitimate. The best way to verify it is by sending a debt validation letter to the agency. Under the federal laws, a creditor or a collection agency is required to send you the details of the debt after they have received your debt validation request. If they don't send the details and continue to call you, you have the rights to file charges against them. To make your side legally stronger, send the letter through certified mail with return receipt requested. Once the company receives your mail, they will have to sign a green slip which will be mailed back to you. You will have concrete evidence that you requested for the details of the account and the company has failed to provide it.

If the company has sent you the details of the debt and you believe that it is inaccurate, dispute it with the company. Explain the situation and request them for verification of the account.

In your case, since you are sure of not having any loan with Platinum B, send a cease and desist letter as well. This will pose legal restrictions on them and they won't be allowed to make any calls to you. If they do so, it will result in violation of federal laws and you can file charges against them with the help of your attorney.

Keep a follow up with Platinum B at 1-866-350-5696

Samples of debt validation letter are kept in this forum.
