Valentine & Kerbatas Strikes Again?
Date: Fri, 08/07/2009 - 08:29
SO! I'm extremely pregnant (going to go any day now) so bare with me. The lovely "law" offices of Valentine and Kerbatas got a hold of me back in May. After threatening me and being the dastardly, self-righteous little punks that they are talked me into a payment plan to pay off a credit card through Chase. The agreement was a certain amount every two weeks out of my paycheck through a withdrawal from my checking account.
Lately, I've noticed that the payments (which are supposed to be withdrawn no later then the Tuesday morning after I get paid) are being withdrawn later and later from the due date. Now they have not collected for this month at all. When I attempted to call them I was told my "case worker" was unavailable and hung up on. I've left voicemails, but they just don't seem to give a damn.
So, I turned around and went home to see if they had a different collection date on their statement, and come to realize I have not received a statement for this month at all from them. Nor did I receive one for the last half of July.
Am I right to contact my bank and put a stop on V&Ki collections until I can get in touch with them? It really, truly seems to me they are trying to pull some sort of wool over my eyes.
As I mentioned before, I'm pregnant, and have not been able to go on maternity leave to cover this collection (I want it taken care of ASAP), plus I have more going on financially without them, V&Ki, jerking me around like this!
Any thoughts or advice would be appreciated.

You stated the paymnet dates became later and later. Did the pay
You stated the paymnet dates became later and later. Did the payment amounts stay the same?
Yes. They never charged more or less, but they'd go say two days
Yes. They never charged more or less, but they'd go say two days over the collection date, now it's been 9 days.
I would not put a top payment. I would make sure that the money
I would not put a top payment. I would make sure that the money is available in the account, and that you can show it was there on the due date. Maybe get a statement from the bank that there were no attempts to withdraw the money on said date. Although, I have to wonder if they still have the account. It almost sounds like they may have sold it, or it was recalled, depending on who the owner is.
