I have followed all the information here and did pretty well - got a couple of PIF's and most of the others have just left me alone. Well I did all that at the beginning of May. Today, my supervisor got a call regarding me from Lewis & Shapiro, saying that they were going to file a civil suit and fraud charges. I called them back and the guy that I spoke with got very belligerent when I said that they could not collect on an illegal loan, and that they should stop calling my place of work. As he got very nasty, I hung up. He then proceeded to call me three more times - I kept hanging up. I then faxed over a C&D letter and will mail it this afternoon when I can get to the post office. This is for a loan with Web payday that I never heard the first thing on when I sent the revocation letter in May. They did not try and call me first, but called my supervisor - I know it is a scare tactic and bullying, but I don't need the hassle here at work. Is thre anything else I can do?

Lewis Shapiro is a collection agency, not a law firm, and they committed two violations of the FDCPA by third party contact and threatening a suit that they can't carry out! If they posed as lawyers that is a third violation. They are located in NY. What state are you in?

NC. I have already filed a complaint with the NC Attorney General's office as they called my supervisor again and said that they needed a schematic of the building as they were going to send someone to serve papers on me.

You need to get an NACA attorney and file a suit ahainst them. Go to www.NACA.org and see if you can find an attorney who will take this on contingency. They will normally settle out of court if they are serviceable. Collectors consider it part of the cost of doing business.

I am receiving calls from them (representing Payday yes)..they are telling me they are going to file a lawsuit against me for fraud, etc. I am in Texas what can I do. I had several payday loans due to medical issues and cant pay them back the way they want.

my friend sal bilello sued.

google sal bilello and lewis shapiro llc. you will see the lawsuit filed in pa courts. his lawyer called yesterday and said basically they are out of business. they havent even paid their lawyers yet. they barely put up a fight. know your rights people. never! and i mean never back down.

Is there a number for this Lewis Shapiro? I get a monthly payment taken out of my account and never receive any correspondence from them. So I went to my bank to see if they had a contact number and the number they have I called. To my shock itis to someones personel cell phone. What can I do??????

For the poster that is in Texas...Texas law requires that lends be licensed with Texas. If they are not, then the contract is null and void as they were not allowed to lend to you in the first place.

Then you can tell all the collectors who call about it to take a hike as the loan was illegal and unenforceable.
