A lady from this company called me with a case number and saying there is a civil suit pending. I am sure it is about a payday loan I took out but defaulted on. I have never received anything in the mail from them. Should I go ahead and send a debt validation letter to them?


I would check with the clerk of the court in your county to see if the case number is legitimate. If they have already filed, then debt validation is not appropriate. You would need to get that information in discovery. If there is no suit filed, then they have 5 days from the date of inital contact to send you a dunning letter, which will have the mini miranda, and the contact infomation to send the dv letter. I, personally, would not send anything until I received the dunning letter.

I do not believe they have filed the case yet. I got a call today saying I have 48 hours to return their phone call or they will advise their client to proceed with the civil complaint.

I am about to send out the DV today (had to wait until payday to get money for the certified letter). I know the DV will not arrive in 48 hours, so will they ignore my request? Can they ignore my request?

I was reading about the dunning letter and several websites have said they are supposed to send me something in writing 5 days after initial contact. Does this apply to contacting me by phone?

The first phone call was Friday and then today I have only 48 hours to contact her. Should I call her back and state she has to send me a letter of collection or does she even have to do this?

The dunning letter has to be sent within 5 days of initial contact. The phone call would be the initial contact. Did you actually speak with them, or was it just a voicemail. I am not completely sure if a voicemail qualifies as a contact. I would talk to them, and I would say that I cannot make any arrangement until I receive the dunning letter. The letter would give their contact address that you would send a dv letter to (CMRRR). It will also tell you that you have 30 days to dispute the debt. This is the time limit to send a dv letter. If you talk to them on the phone, do not give them anything before you recieve the dunning letter. Do not acknowledge that the debt is yours, and do not promise that you will pay anything. If you do not have an agreement with them in writing, and they have not validated the debt, then I would not pay them anything.

Authorized PayDay sent to National Credit Adjustors who sent it to Hagulworth and Associates. She would not give out their address. They will send some information to me in an email. I found their address on another website and sent a debt validation letter to that address but I have not received the paper whether they signed for it or not.

They said it was for $700 because of all of the late fees, but they were willing to go down to the original debt of $400.

Can I send them a debt validation letter through email? I want all of the information so I can negotiate down to what I have already paid them.

Any thoughts on how I should proceed?

yes you can send vaidation requests by e-mail.just attach a receipt to it.

I sent Hagulworth an email stating how much I can pay and when I can pay it, also sending by money order. This was Thursday 09/10/2009. I still have not heard back from them. Do I need to send them another email stating that I am not paying until the send me a letter/email stating they accept or decline my offer?

coffmanla, do not send them any money. When they call back, ask for something in writing. I'm fairly positive these people aren't who you got your payday loan from. If this is in fact the case, deal directly with the people who got your loan from. Someone in my family had a situation like this before. Anyway, making a long story short, you need to get something in writing in the mail from them to make this legit, you also need to deal directly with your loan agency because there is an excellent chance that the people that called you are scamming you. Third, if they ever say anything about the cops coming to get you, or if they sound like they are harassing you in anyway, that's the final sign to know they are not legit. Please though, do not send them any money or give out any personal information to them until you get somehthing in writing.
