Rubin and Debski for Capital One Judgement
Date: Fri, 08/14/2009 - 14:57
I have been paying on a judgment $100 a month since last November 2008. I can no longer afford to pay $100 a month and when I asked this Legal firm to call me back to negotiate for $50 they won't call me. So, can I just start paying $50 since my hours have been cut at work. I am head of household so I know they can't garnish my wages although I don't doubt they could try it.
Thanks in advance!
I don't know if the judgement amount can be negotiated. :(

In Florida they cannot garnish your wages if you are head of household, meaning that you provide more than 50% of the living expenses of a dependant. They can levy your bank account. and put liens on your property.
I would send the $50, and wait for them to contact me. Mhy opinion is that if I make the effort to contact them, and they do no respond, then that is their problem. It may not be right, but I don't like to play by their rules.
Do they have your banking info? If they are debiting your account derectly, then it will be more difficult to change the amount. You may need to close that account and open a new one.

Not true. They are garnishing mine. They state since I have no minor children. I am about to lose my home over this garnishment.
