Ok --Husband received summons from the court, being sued from HSBC. We received the summons on July 23rd and we had 30 days to answer. We are filling BK, within a couple of weeks. My question is once the 30 days lapses, does it still take some time before they can actually get a judgement? I'm hoping we file our BK before anything is sent to my husbands employer for a garnishment.

I would not worry about the judgement. Even if they get one, it takes time to "enforce". If you are filing bankrupcy, then the judgement would be eliminated in the discharge. It would also be included in the automatic stay. As my attorney advised, do not even worry about receiving a summons. It will all be wiped out later anyway.
