Hi,
i had LVNV contact me and in fact we had a court date in which i had sent them the debt verification letter just before the date. i didn't hear anything so i thought it was solved. i didn't go, stupid i know but i can't change that now. about a week later i got a letter from Resurgent Capital Services, which is LVNV saying "We have taken the necessary actions to ensure you will receive no further communications from Resurgent Capital Services L.P. If you have any further questions please contact one of our customer service reps. and the next page was the validation of debt page. i thought that that meant that they were going to go away. now a week later i receive a letter from the law offices of Howard Lee Schiff, PC
in which he is requesting a contempt hearing with the appropriate papers for service to the defendant. and and affidavit of non-compliance.
how is this not contacting me?
what is happening now? can someone please help me. i have no idea what is happening and i am very scared. thanks
Did they actually get a default judgement on you? The lawyer is
Did they actually get a default judgement on you? The lawyer is not Resurgent, so technically, they are not contacting you, at least on paper. If they have a judgement, then I would suggest that you try to work out a payment arrangement with the lawyer. If not, then they may be able to garnish your wages, levy your bank accounts, and put liens on any property that you own.
they are allowed to contact you regarding legal proceedings even
they are allowed to contact you regarding legal proceedings even if you state that they should never contact you. heck, wouldnt you want to know that someone was proceeding against you legally?
After you get a judgement against you, they are required by law
After you get a judgement against you, they are required by law to contact you and prove they did so they can get permission to garnish, seize assets, etc. etc. (called Enforcement of Judgement).
The court process is a whole different animal than normal collection activities.
