Does she own a home or car would be the question? Since she is on social security they can not touch her money at this time but they could go after her home or car with a lien. What they are really wanting out of her is just a default judgment so they can add interest over years and one day have the judgment enforced when she is back on her feet.

Someone familiar with FL law may be able to assist on this question. Since it's a joint mortgage I am not sure if they would press a lien on the home but in all honesty it would not surprise me :(. With the faster civil suits hitting the courts these days, thanks to Obama and credit card companies push to clear records prior to the end of the year, chances are they have all paperwork in play to show proof of debt. Considering her situation and your fathers do they make more than 35K a year? IF not have you considered looking into legal aid just in case she has a chance to prevent a lawsuit by them not having proper documentation (it's just a chance).
I am sad to hear her story and wish her the best of luck with this. Right before the case hits a court room they will offer her a settlement between 40-60% of the original debt so hopefully she can get this settled that way as a way of last resort.
