I sent an email to the CFSA, let's see if I get any results. Since I don't know the exact location I basically told them Texas. You need to print out the industries best practices and TAKE it into the store to prove to them what an EPP is, and how members of the CFSA MUST honor it, or you will see to it that they have their membership revoked by filing complaints with the CFSA. You really need to stand up for yourself, they are yanking your chains! Here is a link for the CFSA industries best practices, print it out and TAKE it into the store. Notice number 11.

Thank you so much! I have printed out the paperwork and will take it in to the store. I am worried about running out of time because I know I have to ask for the EPP before it is due. When you do go into the store with that printed out paper, take a note book with you so you can jot down the name of the employee, date & time you gave this information to her, also note that you were requesting an EPP, ask her/him to sign it so you will have proof you requested an extended payment plan BEFORE the payment was due.

If its an installment loan then I don't think they would have to honor the CFSA EPP because I believe thats only for payday advances. Although thats still no excuse for the employee as they should have explained that.

I am ready to scream because I can't get a straight answer on this. I plan to call their corporate office today but from what I've found in other posts, they are not of much assistance until AFTER default, which is too late for the EPP.

Anyways, The Cash Store is a new member, what I was told is they probably aren't aware of the industries best practices (no excuse), soooooooooo, you need to follow the advice I gave you above, print the sheet out and take it to the store! Tell them an adviser of yours (that's me but it kinda sounds official lol) spoke with a representative at the CFSA in Alexandria, VA and she suggested that you file a complaint, link below, then fax it
to : 703-684-1219. I was told that as a member they MUST abide by the industries best practices or possibly lose their membership.

Actually, I specifically named Plano, TX, she said that unless The Cash Store is operating as a CSO they SHOULD offer the EPP. I checked the CSO data base and they aren't listed there. I hope there isn't some state law I am not aware of that's going to poo poo all over this EPP and prevent you from obtaining it. :D

Update... I'm not sure what's going to happen yet. I went to the store on the way home and talked with the two people there. I explained that I could not pay them and no longer had direct deposit. I guaranteed that the payment would be returned to them and wanted to make arrangements. I explained EPP and showed them the paperwork. The manager said he would call corporate in the morning and call me back. He said they would be able to give them guidance on what to do. We agreed that plan B should be to make payments when I could to satisfy the debt. I feel a lot better, no matter what happens. Shazzers, I can't thank you enough. I'll follow-up and let you know how it turns out, in case my sad situation may help someone else.
I have another PDL I am trying to figure out. It is with Dr. Cash (internet). Should I post my question here or start a new thread? I'm going to do a little more research for now. This discussion board has been a huge blessing. I honestly thought I was the only one in this situation. The advice and the moral support is very appreciated!

The Cash Store manager called me back today. Corporate didn't know about the EPP either. The manager said that it will go through the usual process of being sent to the bank. I told him I would come in and make payments as I have funds available. After some time, corporate will pull the loan to their collection department. They said they would set up a payment plan to me once it gets pulled into corporate. It's not the EPP, but at least they are willing to work with me. And my bank account is closed now so that won't be an issue. My bank branch blocked it from being reopened.

Okay so if PDLs in Texas operate as a CSO they don't have to offer EPP. That suck since people in other states have the oppertunity to use an EPP one time out the year to help them get out of the payday trap. The only choice you have as a Texan is to close your account go into default to then get the PDL companies to work with you on a payment plan. However, the Cash Store is NOT listed as a CSO. CSO's are required to "Register" with the Secretary of State, The Cash Store isn't, they operate as a payday lender.

I was just reading all of the information that you had found out about The Cash Store (the location I am using is in Irving) and setting up an EPP. I just spoke to the store, they are not aware of anything that has to do with the EPP, but said they can roll me into an installment loan as of this coming Monday. The store said the installment loan is a little more expensive, but will have me at 10 payments. I am not sure what to do at this point, what would you suggest?

Yes, you should be able to, they are listed as a CFSA member at the link below:

If they give you any hassle over it, print out that page that lists them as a member, and print out the page at the link below whci shows the industries best practices, ask them WHY they aren't honoring those practices if they're members, if they still won't honor it then tell them you will have to report them to the CFSA and have their membership revoked.

I can't afford to pay it all in full. They want me to pay the return check charge and resume the loan as usual, which leaves me in the same boat. Good grief!!

You know what I think, a lot of these legal payday lenders join organizations because they get a nice plaque to hang on their walls or banner to place on their website BUT, they fail to read what the requirements are when they join. So, when one of their customers actually request a service of them that is named at the CFSA site, they are just clueless! lol

Hi Shazzers. Do you have the information or a link to anything that I can use to prove that The Cash Store has to register as a CSO? Where do I go to show that they are not registered?? My file was recently transferred to corporate collections so I am working on a letter to get them to agree to a payment plan. They want me to pay the return check fees and get back on the same sinking ship I was on before and I just can't do that. I want the EPP!!!

I think they offer both, check your contract to see if your loan was a payday loan or personal loan.

The loan I have means I pay a finance charge every 2 weeks with no change in the principal unless I can afford to pay a little more.
I have a special request for anyone reading this post that has a loan with the Cash Store whether you have posted a question or not. There is strength in numbers.
PLEASE DO THE FOLLOWING:
1. Request the EPP.
2. File a complaint with the CFSA if they do not offer the EPP.
3. Send a letter to the corporate collections department, with a copy of the CFSA Best Practices (Shazzers provided the link earlier in the post) stating that they are in violation and you are requesting a comparable payment plan. I also emphasized that I was an "excellent" customer.
I hope that if enough people call them out on this and they get enough complaints, they will at least remove the CFSA signs because they mean nothing and essentially, it's false advertisement (and false hope to people like me). I hope that they will reconsider how they handle customers that want to clear their accounts properly. It's sad because I pointed out in my letter to them that several non-CFSA members, even those operating as CSO's, offer EPP's in the state of Texas. They may not call them EPP but they are the same concept - skip a payment, 4 equal payments, no additional fees. These payment plans have helped me get rid of several payday loans with The Cash Store being the last thorn in my side.

I just got an email from a supervisor who asked me to contact him personally concerning my account. I hope this is a good sign. I appreciate them adhering to my request.

Update... I spoke with the supervisor. You could tell he was extremely nervous about the letter. It went to the head of the collections department, because the supervisor said he was given "permission" from his management to waive the returned check fee and set up a payment plan. He was very courteous. I make my first plan this Friday. After I make 4 payments, he said the store can set me up on a new loan for the balance... NOT GOING TO HAPPEN! I'll do everything I can to make the 4th payment be the last payment. The supervisor said I could call him any time and he wanted me to know that he will "go to bat" to make sure this is all taken care of to my satisfaction. Yes, his words were "go to bat".
The sad part of this is if they would just honor the EPP, none of this would have ever happened. They need to take down the CFSA signs. When I make my payment, I'll let you guys know if the signs are gone!

You send the revoke notice to the place you recieved your advance as well as the corp office. You must do both of thes. If you just put a stop payment they will represent it to your bank my way of ach adding the returned ck fee .

Always make sure you check your state payday loans laws first, some states will allow for criminal prosecution if you stop payment on a check for a payday loan.
