I don't know if this question has been asked and answered before, but can a debt collector call and leave a message on your home phone stating they are a CA and thats in reference to a debt and that they are trying to collect on that debt.

i think its nco they leave me automated messages somtimes and they have that disclosure that says "this is an attempt to collect a debt, and any information obtained will be used" i'm sure you know the rest. i never thought about it but how can they know for sure that is my number they are leaving the message on. sure the origonal creditor gave them my number, but what if i changed my number and the number they have has been recycled.

if its a 3rd party agency you need to send them a cease & desist letter, certified mail with return recipt. that way you have a copy of the signiture for whoever signed for it. state in the letter they are not allowed to call you, your job, or any of your refrences you may or may not have left. then you can file a complaint with the ftc, and your state attorney general. also the bbb if you want, i've heard mixed results with the bbb though. my personal experiance the bbb didnt really do anything, just added more show for the drama. i would start there, it takes some time, but get the c&d sent asap though. good luck.

I would like more information about why they can't leave a recorded message and how one could collect $1,000 from the CA doing this.

they can leave messages, depending on how it is worded. it might sound funny and ridiculous but they can leave a message stating "if you are not so and so please hang up. by continuing to listen you acknowledge you are so and so... " so it depends on how the message is worded.

You would file a lawsuit against them in Federal court. The FDCPA not only grants you statutory damages but can also grant you court costs and reasonable attorney fees if requested, so if you have a documented violation of the FDCPA it should be relatively easy to find an attorney to work pro bono (at no cost to you).

According to the following article by ACA International, the Association of Credit and Collection Professionals, they can:

(The article on the ACA website requires log-in. Remove any added spaces from the above web address, if any.)

See the bottom of the article for their recommended format.
