I am being sued and need help

A friend of mine used this site before and found it extremely helpful. She recommended it to me.

I'll get to the point...I have done some stupid things. One of them was running up a credit card debt back in 2004-2005. I was stupid, irresponsible and truthfully, I was using illicit substances at the time.

Several collection agencies have contacted me about this before, but I was never in a position to pay them anything or agree to any sort of installment plan.

I am a college student with no current income and very few assets. I live with my parents. I want to do right by this, and I had plans to work my tail off over the summer and get this off my shoulders, however I was injured in April and needed surgery. I have not worked since April, had the surgery in May and am still unable to work, need a second surgery in December and I have no clue as to how soon I will be able to work after that. I have an appointment with my orthopedic surgeon this Tuesday to work on getting documentation for all of this.

I am being sued by Yale R. Levy from Levy & Associates LLC. The name of the attorney assigned to my case is David Ringlein. I contacted them and informed them of my situation described above. The law clerk I spoke with only offered me a settlement amount that I cannot afford.

The summons says I need to file an answer within 28 days and I received it 2 days ago, so that would be 26 days now.

I have no idea what to do and am very, very intimidated by all of this. Can anyone help me?


You should file an answer to the complaint. There are suggestions here and on other forums on the Web. Or you could file bankruptcy. Or just take the judgment. Right now it sounds like you are judgment-proof. If you go back to work they can only take 25% of your wages.

How are you paying for the medical bills? If these are going to be a problem, you may want to wait to file bankruptcy so you can include them. You don't want to file too early and find you have more debt you can't pay, as you have to wait 8 years before you can file again.
