I know this sounds kind of shady but if you get a letter and you are being sued, can you close your bank acct before you go to court (assuming you know you'll lose) so that they can't seize the funds? I understand garnishment and am fine with that but i wanted to know if this was possible.

most likely they will find a bank account either way.if you are going to close the current acount.they will find the new one.how do you know you'll lose, and unless you agree to a payment structure in court.there is no guarantee of your account being seized.

Well i wasn't going to open a new one until this thing was over. I know i'll lose because i know the debt is mine. The CA will not work a payment plan with me (redline recovery) and after our last conversation i refuse to talk to them as they are nasty nasty people on the phone. I cannot afford for them to drain my acct of all the money, so i'd rather just give it to my fiance and let her write me checks until this thing blows over.

I have heard others refer to "discovery" phase of lawsuit - apparently you have to reveal all your resources - but if you don't show up they get a judgment against you without it - so who knows - I have a PayPal account and am wondering how they would go after that ... and if PayPal would close my account if I go BK.

did they ever validate their right to collect or the amount that they are trying to collect?you can answer the summons and demand validation during discovery.
