I had 3 payday loans with Avantis Financial
Loan 400 paid $692.80 paid off with fees and paydowns
Loan 500 paid $866.00 paid off with fees and paydowns
Loan $300 I have not paid anything on this yet.
After reading all the posts I realized they were illegal and I was
only repsonsible for the principle. I sent them a ACH Letter
revoking any debits from my checking and along with a cease
and desist letter. They called my job and was told they were not allowed
to call anymore. Today I received a letter in the mail stating that they
had sent a letter to my job and will not honor the voluntary wage assignment, but required a court judgement to initiate a garnishment of wages for me.No such letter ever arrived. They are filing a claim against me in Minnehaha County court in the next several weeks. After obtaining a judgement their attorney will send my company the appropriate garnishment papers. Please expect thesed documents approx. eight weeks from now. They expect the final judgment incl.court cost will be approx $540.00 And they ask me to contact their office.

I am willing to pay them the $300 but I think they owe me $658.80
in fees I overpaid. In my letter to them I told them to deduct the
$300 I owe them and to send me the $348.80 that they still owe
me in fees.

My question can they place a judgement against me and any advice
regarding this problem would help.:(


What?? You are getting sued by an illegal pdl lender?

Dm, if the lender is illegal then they can't sue you. I think it's only their scare tactic. Have you checked with the court if a case has been filed against you?

Further, you don't owe more than the principal amount to an illegal lender and also the lender can't report to the credit bureaus.
