Being Sued by "Discover"

I had written last week after receiving a "summons" in my front door and saying that I planned to meet with a BK attorney as soon as possible. Part of the discussion was over whether or not the phone calls from the CA representing Discover that started right after delivery of the summons were, in fact, attempts to see if I'd been scared enough to settle. Most posters seemed to think that was just wishful thinking on my part. This week, I got a follow up from the CA in the mail asking just that. They are "promising" that this doesn't need to go to court if I will just agree to pay them $300 a month for the next 5 years. While I SINCERELY wish that all my creditors would propose manageable monthly payments so that this can be fixed without BK or lawsuits - I still can't afford to give one of them $300 while the others will get nothing as a result. $300 is just about 3/4 of one week's income for me - and I would still owe 5 other creditors almost $60K total. So that won't fly. I guess my point here is just to let others know who are receiving "summons" that, while you should take it seriously and do everything in your power to play by the rules (i.e. file your Answer) - there is still not necessarily a need to panic - just make sure they don't get their day in court without you there or they will get an automatic judgment against you.


Paying Discover at the expense of other bills, if you qualify for a no-asset bankruptcy, would be throwing good money after bad. Sounds like you might qualify for bankruptcy, so don't hesitate to contact an attorney in your area for a consultation. $60k is just too much to handle if you're only bringing home $400 per week.
