Last year I took out a PDL with Eastside Lenders (ESL) for $300. Due to some medical issues I defaulted on the loan. The website for ESL states I owe $415 and the account went to collections. Now, a rep from Smith, Haynes and Watson, LLC smithhyanes.com called me and states I owe $705. When I asked them why is it so high, it was due to late fees, processing etc. I told them I understand the $415 fee but not $705. So here is what I did, I began a payment plan of $75 a month until the debt is paid but I did not give them my checking information, I gave them my debit card info. The reason I did this is, it is easier for the bank to place a holdon the card versus the checking account. Additonally, cancelling the card won't crewate any issue with any pending checks.

So here is the question, should I stop paying ESL once I reached $415, because that is what their website indicates I owe.


so here is how ESL and Smith-Haynes are playing the game. As I stated before, I sent ESL two bank checks to pay off my account but the checks have yet to be cashed. ESL says that Smith-Haynes owns the loan and Smit-Haynes says it is ESL. So, since the BBB settlement letter was addressed to ESL and ESL accepted my offer, I am leaving things as is and I am done. I decided not to worry about it because I made good on my loan and ESL and Smith-Haynes can play their game until the end of time!!

They are also playing a game with me. Smith/Haynes calls ESL "their client". Smith Haynes sent me debt validation to which I responded via certified mail. I made them an offer and requested acceptance in writing. Then I get a voice mail saying that yesterday was the last day for ME to respond.....

I think when I send them a payment (after they accept in writing) that I too will use the bill pay system with my bank. They want me to use prepaid debit card, but I want a paper trail.

Don't think I'll respond to the voice mail either.......They are pissing me off!

I feel your pain! I know with some prepaid cards (the reloadbale one), you can go online and check your balance and debits. But in my opinion, use bill pay. It's free with most banks and the banks with provide you with a copy of the "bill pays" canceled check. Using one of these products keeps your bank account secure. Now what I did, I filed a complainted with the Delaware BBB and within three weeks ESL sent me a letter via the BBB, that they accept my offer of $350, $300 plus two NFS fees. I was told Smith Haynes has the account but why did ESL respond and accept my offer??? They are ALL crooks and liars. You need to get something in writing about your offer and be sure that the letter you receive references both companies,i.e., ESL accept aubrey offer on behalf of Smith Haynes or Smith Haynes on behalf of ESL accept the offer of... What you don't want to have happen is paying ESL and them not telling Smith Haynes or vice versa and still having an unpaid account outthere. I hope I made sence.
