you guys have been the only thing keeping me going. update i am unemployed. and have all storefronts out in ohio, last week they all said if i did not pay they were filing charges against me... the stores are ace cash express, national check cashers, always loans, advance america, and cashland, i got traped my boss was going to fire me did not but cut my pay i had to take out these advances to surive i am a single day with an 8 year old daughter, well a lawfirm called me yesterday said they were filing check fraud charges against becase i did not tell them about my cut in pay. they said since the check was over 500 it was a crime . i do not have it i will not have unemployment till sept 17th. all of these places are telling me i will be prosocuted for writing a bad check. i called our local police dept they said the worst thing that could happen is i can get suied this is not a crime to default on a ohio storefront loan, i was paying 25 to 50 dollars on each one but they do not care about me being unemployed they said on tue they are coming to my house to ask for the money. i am at my wits end losing it i do not have it to give right not. without you guys support i would not get through this. i have been told by the police, i have been told by you guys before but this is killing me in my mind if i go to court i will lose my daughter to childrens services. plus i talked to another girl at advance america she has been nice she said it is not a crime, also these places are still killing my bank account everyday they are hitting my account i have a negitive balance of 500 as of this am. all of the pdls said if i colsed my account that would be fraud i do not know what to do please respond . and thank you for listening to my story you guys are all i got to keep me going. todd


they just called my grandma asking for her routing number for thebank tellingher i would have charges file against me next week if she did not help i told her not to is thank the right thing to do they are calling her on monday for what they said is a last chance . charges of writing a bad check a fraud because i did not tell them in time i got fired. help todd

its todd as of friday they said it would go to the leagel dept,to pursue charges against me and that since i did not tell them i did not get fired only reduced my pay at the time that i committed check fraud , since than he did fire us and i am unemployed. they told me it was going to a law firm

They are just trying to scare you. If the police told you that you couldn't be arrested, why wont you just relax and believe them. It is really low of them to call your grandmother. I would close the bank account and not answer the phone. One your checks start coming in try to pay them anything until you get it paid off. Until then, just worry about your daughter and putting food on the table. People do not lose their children because they defaulted on a "probably illegal" payday loan. I think people should pay what they owe though because otherwise it is stealing.

thanks pam i plan on paying them back when i get a job i will pay them what i can, i am just scared to death, when they said that i broke the law that scares me i am a good guy in over my head. they said i am in the leagel dept and my case is being filed these are ohio store fronts so they are leagel, thanks for your help i am on the verge of losing my mind. todd

The worst that can happen is; it will probably be turned over to a collection agency, you will receive a dunning letter (if they follow the federal law) stating who the debt is for and what the amount is, at which time you can request validation. They may or may not sue you in a court of law, if they do, you can explain and prove you are unemployed, the judge will probably order the collection agency to set up a payment plan.

Thanks I just am a person who wants to do the right thing but do not have money also you said the worst thing to happen would be they sue me. If that happens can they garnish unemployment. Also should I keep my bank account open or close. Would that be fraud on my part if I closed it. Thanks you eased my mind about not going to jail for my pdls. Todd

They can garnish your wages if you don't show up in court, then they would get a default judgment against you which would open the door for them to garnish your wages, this is why it's VERY important you GO TO COURT if the time comes. That's the only way you can speak up for yourself is by showing up in court! You also have more rights than you probably realize. IF these accounts do go to a collection agency, they (the collection agency) are bound by federal law to follow the FDCPA (Fair Debt Collection Practice Act), it would be in your best interest to educate yourself on your rights, just google it or research it on this site. Nevertheless, it would probably be awhile before it would go into a court of law because there is a protocol they would need to follow first.

OK, I re-read your first post. What was this attorney's office called? Their name? Have you ever received any documentation via the mail regarding ANY of these loans? Such as a statement with the amount of the debt on it and who the original creditor is? If so, was there something on any of these statements which said "This is a bill from a debt collector, this is an attempt to collect a debt, blah blah blah????

You know, the more I think about this the more I am realizing that this so-called attorneys office broke the law by calling you and making threats they can't follow through with. You really need to report this to your Attorney General's office, you can fill out a complaint online, but you need to report the name, address and phone number of the people who called you and made such a threat. You need to be very specific about the details of this phone call. You should also file complaints with the Federal Trade Commission. All you need to do is click on the links in my signature, it's very easy to file complaints and it would be in your best interest to do so.

I'm sorry that you have to live in fear, it's a shame that there isn't SOMEthing we as individuals can't do to put a stop to this type of treatment altogether. The best we can do for ourselves is to educate ourself on our rights as consumers and debtors, because let's face it, this country (and government) is WAY over our heads in debt, which is one of the main reasons why the banks, credit card companies, stock market and everything else has went to the dogs.

thanks paul but for sure i can rest easy it is cival not criminal right , i know i have to take care of this but i know on tue i am going to get really bad phone call that i wrote a bad check, and will have fraud charges against me. soory to be a whimp but i am a single parent who does not want a problem like this. thanks paul for all of your thoughts i relly appriate them.. todd

thanks they are saying because i told them that i lost my job , but they only cut my pay, and i did not update them on that is that i fraud them i did lose my job in the end, they are coming after me for misleading them i did not i got fired, on july15th told them that the next day boss cuts my pay instead i forgot to call them 2 weeks ago helet me go . they are saying i lied i am unemployed i even called our local police they said i did noything wrong what do you think. thanks for your support i would go nuts without you guys, sorry i am a loser and got in over my head. had to feed my daughter. thanks todd
