again,if you are unemployed, and can show that your bank account contains only your unemployment funds.they can get a judgement, but won't be able to do anything.at least not until you get a job.they can't garnish your check or seize the account.however,it still sounds like they are threatening criminal action.which they can't do.i would wait to see if they call again.

Honestly, it appears like they provided you with sound advice. The key is how you perceive thier statements. I believe that they have in fact turned the account over to thier atty and they are going to file in court and you should speak to an atty if you wish. It sounds like a carefully worded statement covering what they are doing and advising. Although it was left open for YOUR interpetation!

No, no charges. They will probably sue you in small claims. If you can avoid this, please do. A judgment will show on your credit and if you own your home, a lein can be placed by the courts. If you are looking for new employment, the judgement can exclude you from a growing number of employers. We are in an "employers" market which means that there are more applicants than jobs. In a situation as this, the employer will use more background checks to pare down the candidates and a credit check will show the judgement. I am not trying to use scare tactics to make you pay, just giving you real life scenarios to aid in your decision.
