civil summons

I got a call today to go to the sheriffs office to pick up some papers. It turns out it is a civil summons for an old credit card that is not quite out of the statute of limitations. The amount due is like $800. I called the place and made arrangements to send them full payment within the next 30 days. I asked them if that would clear everything up and they said yes and that the court would not proceed with anything unless they asked them to and as long as I send the money they won't. Here's my question, I know it seems vain but, will my name and the situation be listed in the newspaper if it never goes any further in the court system? That would be HORRIBLE!


I don't mean publish as a way of serving me. We actually get court proceedings/judgements published in our newspaper. I don't know if they are there only if a judgement is given or if just by them sending a civil summons. It is not a court summons, but is a civil summons. They told me that either I or my attorney should contact them within 20 days of today.

You need to read the summons carefully. You may be required to answer it in writing and there may be a deadline for doing that. The deadline may be less than the 30 days you agreed to.

If you plan to pay it and can before the deadline, then you can send proof that it is paid with your answer. If you are supposed to answer and don't answer they may get a default judgement.

I don't know about the newspaper, but if they get a judgement it'll stay on your credit report for 7 years...paid or not.

First off its not the court pursuing the credit card debt it the collection company or attny. If they agreed to let you come in on a certain date and pay the debt in full on a certain date all they have to do is call the clerk of the district court and ask for a later date. When you do pay the debt that will close the file and you wont have to go to court. If the summons was not printed in the paper than chances are nothing else will be. Just make shure you get a P.I.F. letter and a copy of sastisfaction satisfaction of judgement if applicable

They told me that they would put in my file that I would be paying in full by the end of the month. I should receive some papers in the mail from them within 2 weeks after that showing that I am paid in full and that if I do not receive them, that I should contact them. So, since I called them today right after receiving the civil summons, and made arrangements and documented who I spoke with, etc, do I still have to respond in writing to the summons (in KY if that matters)? What if I do not respond in writing and pay in full....can they get a judgement still and for what at that point?

If you set up a pay agreement they have to send you a copy of that agreement. (By fdc law) Request they fax or e-mail that to you. (If you want a copy of PTP agreement just for your records) When you pay the debt they have to send out the letter that day. (reason for the pif letter is 1. proof the debt is paid. 2. to present to appropriate agencies to get debt removed from credit report if filed on credit. 3. protects you against cmpny trying later down the road to file again on the same bebt.) If all possable make the last paymnt in person. (that way they will have no excuse not to give you a pif letter. As far as responding to the summons DO NOT TRUST THE COLLECTOR AND WHAT THEY SAY!!! call the clerk of the district court they will tell you if you have to respond. If you just pay in full before the court date you shouldent have to make an apperance in court. If you dont get it paid in full remember if the company does call the courts and cancels the actions against you and you dont hold up your end they can reinstate the case and most likely the judge will side with them. Has the collectors been rude to you in any way? Or used the legal system as a threat?

I didn't get a court summons. Just a civil summons. There is no court date. Just says that I have 20 days to contact them or they will seek a judgement. There office is hours away from where I live. In person payment is not feasible. I think they gave the mail system time to get the letter to me. No threats were ever made. I called them after picking up the summons and told them that I would send payment in full.

Good Morning Everyone!
Im new in this community, I received a Civil Court Letter saying Citibank is suing me, and I have till October5 to answer or pay , right now Im going to a very hard situation, my husband lost one of his job back in May and the other one he has is just for pay the morgate ! Thanks God we are update! And i have to deal w the other house bills and college tuition, car, commuting cost etc, And I cant pay my own bills. Im so nervous and so lost I made an appt w Agency to help me w my situation,I have till the 5 of October to answer the letter and my appt will be 3 days before.I really dont want to file for BK maybe find another alternative? Right now I cant make any deal w the Lawyer till my husband gets another job? Should I answer the letter o wait till talk to agency? Can anyone give me some inputs what to do.Thank you
