If you can't pay, you can't pay. Keep track of their calls (date, time and anything they say to you) and talk to a lawyer if MB really starts to put the pressure on. In the mean time, save up and maybe they'll offer you a lower settlement amount. You do have rights against harassment under the Fair Debt Collection Practices Act, but make sure you have good information on contacts by MB or else you won't be able to assert your rights. Even if they have been served you with a summons, just make sure you respond in time and file an answer. These lawyers rely on consumer ignorance and fear to get default judgements on people that don't respond, which is some insanely high percentage of people served, like 96%.

I don't have any actual experience with Mann Bracket per se, but I make the following comments based on my personal experience with debt collection agencies and lawyers:

It is not in the best interest of collection agencies or collection lawyers to actually go all the way to a court date. Especially if you are insolvent, because even if they get a judgment on you, they may never get reimbursed for the debt or their time in court (i.e. legal fees are expensive.)

If they push, you answer, and you show up for a "case managment" hearing or equivalent, likely they will be way more willing to negotiate repayment terms with you, because you have taken yourself out of that "easy target" category (i.e. they can't get a default judgement on you.) And they would be more motivated, since they likely don't really want to spend the time and effort on a trial.

When you deal with them, and you let it me known that you know your rights and will be invoking them in your defence, you stand a much greater chance of negotiation (in other words, "Knowledge Is Power".)

I have had experience with Mann Bracken and they are the worst of the worst. NEVER trust ANYthing they say over the phone, if you are actually considering negotiating a settlement with them GET IT IN WRITING. Also, when you send payments send it certified mail return receipt requested, keep track and PROOF of EVERY dime you send to them, they are more crooked than a dogs hind leg!
