Question about "we bought your debt" and C/D letter
Date: Wed, 09/16/2009 - 15:01
I have a credit card that I defaulted on when my hubby got laid off temporarily. Up until that time, I made on time and above minimum payments on it. The balance at the time I closed the accoutn was $425. HSBC of course sent me to collections (Academy...of course) and when I let them know 2 weeks ago amid one of their many phone calls that we were now filing bankruptcy, they got all pissy. They continued to call though, and so I sent a C/D letter to them.
Well now today I get in the mail a letter from Portfolio Recovery Services stating they have "bought this debt" and that I need to get it paid now.
My question is this: Can Academy sell off my debt to someone else, AFTER I sent a C/D letter AND gave them our BK case number? And, can Portfolio still attempt to collect on this debt even if it is a part of a BK?
Thanks!

Well, they did. When they realised that they can't collect from you anymore, they simply sold it off to another JDB to cover their expenses.
Now, can they really do this?? No!
Well, I should clarify, when your Discharge becomes official the
Well, I should clarify, when your Discharge becomes official then no they can't. It was a sneaky move on their part, but it's Portfolio's loss!
