David J Apothaker and Associates are suing me ove $1000.00
Date: Wed, 09/16/2009 - 16:58
I live in Pennsylvania. My husband divorced me in 2006 and ever since then struggled to keep current on my cc bills. Had to find a roof over my head so that became top priority in my life and still is. Needless to say had to survive with only my income and my own rent. So cc bills became a last priority to get paid. Some years later I have a sherriff show up to serve me papers from Mr Apothaker that I am being sued. I don't know who the original creditor is as it has Northstar Capital which I do not have any idea who they are. Hearing is in November.
I get a second letter just today saying that I am in default because I have failed to enter a written appearance personally by either myself or attorney. I cannot afford an attorney to represent me and I have already been raked over the coals twice by my x husband in court as well regarding money I have to pay him as well.
What should be my next step?
Is it too late to call the original creditor to work out a payment plan?
I have recently bought a house for less than what most people would pay for their cars, and am afraid they will try to take it off of me or make me sell my belongings.
Thanks kindly everyone..

Call your local county court and double check. If there was a default judgement, file a Motion to Dismiss due to Improper Service (ask them how) since you never got the summons.
I am thinking since they wrote to you and said "hearing is in Nov" and then wrote to you in Sep and said "you now have a judgement" then one of them is a lie and you can sue them in Federal court for the 1 and collect your $1,000.

Hmmm... Well, that is a very good question! You usually have 20 days to respond. But still, the hearing is in November. At any rate, call the court first and verify everything so we can figure this out.
