Asset Acceptance mess
Date: Thu, 09/17/2009 - 07:22
Back in jan of 09 I pulled my 3 bureau credit report. There was a listing on there being reported to Equifax and Experian. The equifax report said
Asset Acceptance account number etc.. Dell Finance Open account 3,548.00 date opened 1/1/0001. At least 120 days past due 2,838.00 Collection Account. Experian reported:Asst Acceptance account number unknown credit extention, review or collection 3,541.00 Date opened 2/1/2007. Closed Seriously past due assigned terms 1 month. I disputed with the credit bureau and somehow it was update.
I then pulled my credit report on 8/25/09 and experian shows same information w/ account in dispute reported by subscriber. Experian shows:
Asset Acceptance Account Number Dell financial Individual account open date opened 2/2007 Date reported 7/2009. High credit 2,838 balance 3,733. date major deliquency first reported 3/2007. comments: consumer disputes. No payment data available. Disputed this again with the credit bureaus and send validation letter to Asset via fax and certified mail return reciept. Received notice from the credit burea that the account had been verified and updated. I received the first letter from asset stating that I owe them money and then many validation letters (all the same) : On asset Acceptance letter head Date Asset account number. Original Creditor: Dell Financial Services Original account number principal 1955.20 interest 1807.26 fees 0.00 along with my personal information name address etc. Again I sent Asset a letter via fax that the validation was not sufficant I need more info. Asset is telling me a payments were made on the account but can not tell me how many and what the amounts were. They could not even tell me what kind of account or what was purchased.
Pulled credit report on 9/3/2009: They have now reported to Transunion.
The info from experian is the same with the balance now being 3762.00
Equifax now shows: 3762.00 opened 2/1/07 open account at least 1220 days past due but shows payment history as ok from sept 07 - Aug 2009. Transunion is reporting Asset acceptance collection account 3762.00 date opened 2/5/2007 open account collection placed for collection. I again disputed the reporting information for the payments and again Equifax verified and update. I have sent a letter to Asset asking them to provide the requested vilidation with in 15 days or remove the collection from my accoutn or I will be forced to sue. Sent registered mail return reciept.
Called asset yesteerday was told by the account manager (supervisor) that they do not have to provide me with anything right now that they have requested the information from Dell and they will let me know when they have it. I informed him that that was information they need to have prior to reporting on my credit in the first place and since Jan they have update my account 2 times and reported to another credit bureau. I informed him that their agency was in violation of the FCRP. He was very nasty. He basically called me stupid and said I have no idea what I am talking about. What is the next step I need to take. We are trying to buy a home and this is severly affecting my chances of geeting it. Thanks

Your next step is to sue them. The fact they updated the information is in violation. You could also contact Dell yourself and see what they have to say.
Did you buy a computer or something from Dell? If so, what was the last balance and when was the last time you paid on it?
If you have no clue what this is, then you need to get it taken care of! In this case I would send a certified letter to the reporting agencies and demand the method of verification. They need to provide you with the name of the person who verified your account and how they verified it. You could also mention including the reporting agencies in the lawsuit if you do not get some answers. The reporting agencies hate being sued and sometimes will remove the account rather then dealing with an irate consumer who is inclined to sue.
You need to get all your information together. Type up an intent to sue letter, give them 15 days again. Include any pertinent information you have gathered and tell them in no uncertain terms you will be filing suit. If they ignore you, file suit on day 16. Trust me, when they get the summons they will change their tune very quickly.
