Need help with PaydayMax and National Credit Adjusters
Date: Tue, 09/29/2009 - 20:18
Around 5 months ago I took out a PaydayMax loan for $300.
Around 4 months ago I paid off the principle of my loan with PaydayMax.
Now somehow they were able to sell my account to NCA (National Credit Adjusters).
The collection agency is attempting to collect $1369.28 as of September 24, 2009!
The letter I received from NCA is at the bottom. Click on the attachment.
I never once received any letter from PaydayMax.
I have went through some other threads and have come to the conclusion that PaydayMax is illegal in NY.

As per the above information what should I do next? Please information is needed urgently. Thank you for taking the time to help me.

I also paid PayDayMax off. I paid about 420. I borrowed 400. They are illegal in my state. About 2 weeks after i paid them off I got a call from a collecter also. He was trying to bla-bla-bla me. I told him that PDM was paid off and they were illegal. So I told him to contact my AG and explain it to them.... I havent heard from them again.

I most certainly paid them off, they are using very nasty methods to try and take more money. This is my last payday loan ever.

Okay...listen good because this is what I did with Paydaymax and I got them completely taken care of:
1 - Go to the Attorney General's website for your state and file a complaint and be truthful! I told the Indiana AG that I borrowed the loan to help meet hard times, paid back the "interest" on it, which was $90 on a $300 principal loan. I referenced the fact that the contract says I would be charged $90 each time I "renewed" the loan and this was in violation of the small loan laws in Indiana. Thankfully, little did I know that Indiana had just revamped their internet payday loan laws, and now they are ALL illegal.
2 - Go to the FTC website and file a complaint on A) the PDL company for operating illegally in your state, and B) the collection agency, citing that they are trying to collect on a debt that has been paid off
3 - Go to the Department of Financial Institutions for your state and file a complaint - they are actually the ones that regulate the small loan laws in most states. The Indiana DFI was also the only ones that could help me once this was all over with, because they have "hound-dogs" as I like to call them, who hunted down Paydaymax and Credit Protection Depot (the CA that PDM used on me) every time either of them moved.
And then you need to wait to hear from one of the above - once you do, take the copy of ANY letter you get from either the AG, FTC or DFI and certify mail it to both Paydaymax AND NCA.....once you have done that, it should take care of the situation. If not, then be prepared to sue at least NCA for violation of the FDCPA.
When I sent PDM and CPD a copy of the cease and desist letter that the Indiana DFI had sent to them, I had a response in 7 days that said they were no longer going to collect on my debt.
Thanks katcunnington I have done 1 and 2 as you have instructed.
Thanks katcunnington I have done 1 and 2 as you have instructed.
As per contacting the New York Department of Financial Institutions I was not able to because the complaint form link was broken. I will be sending them a complaint through the postal service.
I am now patiently waiting for a cease and desist letter.
I cannot believe how a illegal PDL company in Alberta, Canada can hire a Collection Agency in Kansas to obtain money which none of the 2 places deserve because it is robbery.
I have paid the principle and the amount of which I borrowed back. I sent a debt validation letter to PaydayMax and 4 months later no answer, also I wrote to them asking for receipts but to no avail.
Hope this works out because hiring an attorney in this matter will involve money which I cannot come by with that easily =/

zman....it looks like the NY DFI may be paired up with New Jerseys.....here is a link that I hope helps you :) Go to the right column and just choose one of the regulators to call and speak with. If they can't help you, they will know who can. Also, call your attorney general's office - they can point you in the right direction also. Good luck and let us know what happens.
