Hello everyone, I really need your help. I cant even sleep at night. heres my story. I took out several payday loans to help me get caught up with bills. But i got in the trap of getting out other loans to pay loans. so now the 16th is coming up and i will be in huge debt. I tried a payday debt cons. co but they charge like 25% of what I owe and initial 100 fee. My question is , is there another company that doesnt charge as much. I need to get the ball rolling before it gets out of control. Im in Ca. and I owe about $2000. some of the companies are zip19, paydaymax, check into cash. i want to pay back but not with the fees they are charging.I will go today to stop all ACH transactions and tell them my check was stolen so i need a new checking account. I guess i just need to make sure theres a way out. I am such a wreck that i cant think straight and end up getting stupid ideas of how to get money to survive in my head. please help

Zip and Payday Max aren't even licensed to lend in your state. But before I go into detail I really need more information from you so we can plan a good course of action to help you. Please list the following information:
We already know you are in CA.
-Names of each pdl company.
-Whether they are store front or Internet.
-How much you borrowed.
-How much you paid so far.

Just for good measure, the link below contains your state payday loan laws:
http://www.debtconsolidationcare.com/paydayloan/explain-pdls-laws.html
California requires payday lenders to be licensed by your state, I know for sure that Zip and PaydayMax are not. What this means is all you are obligated to pay them back is the amount you borrowed to begin with, less whatever you have paid them already, no interest or fees. Unfortunately there is no way to stop them other than closing your account asap, your account will never be safe again now that these illegal lenders have your account information. I am giving you a link on how to deal with illegal lenders, please read it and follow it step by step, don't skip any steps, everything you do to protect yourself from illegal lenders must be done in sequence. I am going to address the legal lenders shortly so hang tight. As soon as you are able to name the other lenders I can tell you whether they are licensed or unlicensed.

Check Into Cash is a member of the CFSA (Community Financial Services Association of America), see the link below.
http://www.cfsa.net/MemberList.aspx
This is good news for you because it means you are eligible for the EPP (Extended payment plan). Read about the EPP at the link below, pay special attention to number 11.
http://www.cfsa.net/industry_best_practices.html

My advice is for you to take care of your legal lenders first, if you can get your account closed you can figure out the unlicensed ones later.

I'm the one that got us in tbis mess so its my job to clean it up.if i close the checking account and reopen a new one will her deposit get transfered over to the new one? we had our checks stolen about 6 months ago and we closed the cehcking account but her deposit went through last time. and we were able to keep our same debit cards.

I'm unsure about that, you probably need to speak with the bank about it, I was thinking your wife would need to tell her employer the new account number but I'm really not sure. One option is to place a debit block on the account, but, you can only deposit and won't be able to debit anything.

ok, i think i found the post that has the letter to send to. thanks. I'm just really nervous about closing my account but I think about the money they are going to take out and it makes me feel a little more at ease. now i've been reading on other post that some banks end up crediting your account for the amounts the illegal companies took from you. is this true? and wont this make it worse for me since i will owe them more now? and again thank you sooo much for all your help. I am finally seeing that light at the end of the tunnel.

yeah thanks for all the help on this.OK so I went to close my account on saturday and they placed a hold on all activity on the old account . They gave me a new account number and they were actually pretty nice about the whole thing. step 2 is done. now on to sending the letters. I have the list of all the lenders that show up on my statement, i will post them up on my lunch to see which ones are legal.

i have another question , the bank teller said I could dispute the charges from these lenders if they are illegal companies and they would credit my account within a few weeks once they investigated. He said they will contact the company requesting proof of me authorizing them to take money from my account. Will the illegal lenders coperate with them or will they just blow them off making wells fargo credit my account? I know a few people on here have had their account credited but how?

I'm unsure what they might do, they're too unpredictable. I would definitely dispute it though.

just an update on my scenario here, i received this email from bestcashadvance. and I am really suprised this is all they are scaring me with just bad credit. I have heard nightmare stories about how they hound you. Should I contact them and any advice on howto deal with them to get the lowest payment?

"I wanted to offer you one last chance to make a payment arrangement to pay off your loan with Best Cash Advance. You can do it in small payments or one lump sum. If you call me to make an arrangement, we will not add any more fees onto the balance. However, if I don’t hear back from you, I will have no choice but to send this to a national collection agency, and they will add extraordinary collection costs to your balance because of your unresponsiveness.

This debt will remain on your credit report for the next 7 years. That’s a tough price to pay for neglecting to pay off your loan. Just think, over the next 7 years you won’t buy a car on credit, or a home, or open a new credit card account, or have a good credit history. Please don’t let this happen. Call me at 888-688-9300 or email me so we can set up a payment plan "

ok so zip19 refuses to work with me and they even offered to re-loan the amount after i pay it!! they say I owe 1100 and want either half of that or all of it. Threatened to call my employer for verification ( what does that mean??) and then send to collections. Should I just let them do that?? seems like maybe a collection agency might be willing to work with me. any advice??

They're probably going to try to evoke a wage assignment, so you need to remind them that you revoked it in the letter you originally sent, print that letter out and give it to your employer so they will know that you revoked the wage assignment a while back.
