I wrote letter after letter, I heard nothing. Then sent a good faith payment in the form of a money order (in april), still nothing. Sent a second payment the very next month (may), also in the form of a money order, still nothing. Then decided the next month (june), being the third month, I would send a check, that way I could watch it through my bank account. It was mailed in July and was never cashed. All the while I am still writing both the CA and the original creditor (in case it was in fact, still in house). Finally in september,(check still hadn't been cashed after being sent in June--whats up with that???),I wrote them a letter, telling them that I wanted my money orders returned and also for the check to be returned uncashed. OR ELSE provide me proof that money had been applied to the account, in other words, I wanted a statement from them showing they applied payments to balance. Because of the way things were going, I was getting a funny feeling about all of this. I gave them 30 days to respond to me or I was contacting the BBB and having them investigated. I told them I would be sending NO MORE MONEY until I heard something from them. I also sent this same letter to wells fargo, letting them know what was going on between me and this collection agency. It was very frustrating to me when all I have been trying to do is take care of this account. Well, on the last day of the 30 days, they cashed my check. Never mind the fact that I asked for it to be returned. I checked with Bank and got copy of check and it is in fact them that cashed. But okay--they cashed it, so thats a good thing, now I'm waiting to receive my statement from them showing that all three months worth of payments had been applied. I told them that I wanted this or else return my money. And that I would not be sending any more money until I heard from them.
Okay-this was September. I still have not 'heard' from them. I only heard from this collection agency ONE TIME and that was the very first letter. I also have not heard from wells fargo through all of this. I do have another account with wells fargo that I send money to every month and they cash and its almost paid off. But they're not saying anything about this one.
**since they cashed my check, until now, I did write collection agency another letter, certified return receipt asking for statement and about payments sent and payment arrangments. They signed letter, I have heard nothing. this was early november.**
And as I pointed out before, we had some bad luck come our way that pulled the rug out from under us, but I am still plugging at paying all of this off and trying to get it straightened out. no 'woe is me' here folks. Just trying to do the right thing.
any opinions on whats going on with this collection agency. I mean, I couldn't be a more perfect client. I got in contact with them, started sending money. wanted arrangements to get this settled. trying to do the right thing. But why am I having to beg them to take my money and why won't they talk to me? they're working this account but I've only heard from them one time.?? this is just strange to me, I'm used to collection agencies being more aggressive. opinions please!!! I am so confused and don't know what to do. until now, I have waited to hear something from someone on this account. but nada so far.

I am aware of this situation that you are going through. I guess Roxette was also looking into this matter. I remember you were told to dispute with the credit bureau and if there is no positive outcome, add a 100 word statement in your file.
You sent some letters to the CRA and later, got a letter back from Experian saying the address to be wrong. I am updated till that part. What happened after that? Did you hear anything from the bureaus? You can opt for a 100 word statement in your file. I am amazed why this collection agency is hiding at the back.

Hi Ben, thanks for responding. The letter that was sent to Experian was in fact returned. I came up with a couple of different addresses for them and wasn't sure which one to try so this is what I did. I again mailed the letter, this time regular mail rather than certified. Just in case it was, yet again, the wrong address for whatever reason. (although according to the internet, it was NOT the wrong address the first time-still scratching my head over that one). I figure that I'll give it a little time to see if they get it, and if its not returned, then I will send another one to the same address, only the correct proper way this time. And if it is returned, then I didn't waste postage fee again.
The other letters were sent to the other agencies on December 13. Still haven't heard anything back from them. I am waiting to see what all this produces, then will do the 100 word insert to explain whatever couldn't be changed.

The system is faulty you know, that is why we cannot rely on them. After all it's our hard earned money dear. There are some small businesses that might be in trouble if debtors don't pay their bills, but how the debtors can drop the money in the darkness?
Shirley, I really feel sad for you. I don't think that they will be able to return your MOs and check. (I will pray though that this does not happen actually) This is the situation that makes us scared and cautious. I have read somewhere in this forum where one collector says - why the debtors ask for validation as they know they are responsible for the debt? See these are the situations that make us careful.

These guys sound like a bunch of clowns. If you want a situation diagnosis from me, my best guess is that since you made monthly payments, they never felt a need to call you. As far as a payment history, CA's just don't do that. They could read it off to you over the phone, but that's about it. I suggest calling them to get the scoop.

But I haven't heard anything from them since the first letter. Not one word since. just really strange to me. Not used to this type of behavior from a CA. If nothing else, after I stopped the payments, it seems that I would have heard something. strange, I've never had to beg a collection agency to take my money before. And if this is in fact 'in house' with wells fargo, they sure aren't interested in getting their money back.
I have all paperwork saved so if they try to pull a fast one and cart me off to court, I have everything to back what I've been through with them.

I really feel for you on this one. Did you say the last payment, a check was in fact cashed by Wells Fargo? That would indicate they still have the account, maybe they recalled it from the Collection Agency since you had maintained contact and a sent payments. I would consider contacting the Wells Fargo Consumer Affairs Department and ask them to investigate the account and it's handling. Maybe they can get to the bottom of this and get you headed in the right direction.

Be sure and mark the letter attention Consumer Affairs so it can find its way the right department faster. You may want to even consider copying in the legal department so they are aware of the situation and may be looking into it from a legal stand point already.
Sometime the underlings are so wrapped up in trying to impress their bosses, they forget what they are doing and you have to go straight to the boss to get the situation figured out.

I have a couple of phone numbers for Wells Fargo Recovery Department. I don't know if this help. Currently I am paying on a closed checking account with them. They have been really nice to me and have worked with me. I make payments at the bank with a personal banker. Although I have contacted Wells Fargo directly, I haven't went through their recovery department or corp office. so I will get on this right away and try to get to the bottom of this. On one hand, if they're ignoring me and don't want to take my money, fine...but its a no win for me cause its showing negative on my credit report.
And on the other, I don't need any surprises in case they try to pull a fast one on me. After all I've been through with them, that would really just tick me off. I have also report this situation to the credit bureaus.

No, it was the collection agency that cashed the check. Wells Fargo has never said one word to me since the write off, no matter how many times I've wrote them. And I've only heard once from this collection agency. This all started about a year ago.

Wells Fargo has been behaving strangely. I have had to call people on Wells Fargo accounts. When I reached them they were incredulous that there was still a balance after they had paid it off completely! I have even had one debtor today call me with proof of payment in full. She put me in contact with the collection agency (Tiburon Financial Services) that handled her Wells Fargo account and that she paid in full with. I called them and sure enough, she was telling the truth! She is not the only Wells Fargo account holder who claims this. What the hell is Wells Fargo doing?

What a strange situation to be in. I've never heard of a creditor or collection agency not wanting money. I would call the recovery department to see what's going on. If you need an address for the credit bureaus, pm me. I've been disputing things on my credit report and have the correct addresses from the bureaus themselves. I even had one thing removed from all three of them within the past week.

Hi. I was curious about something. You may have read me talking about this in another post. But when I sent my dispute letters to the credit bureaus...I sent letters to all three, for me and my husband, so there were six letters. The two that were sent to Experian were returned. Said I had the wrong address. According to what I found on the internet and what the mods in here told me, I had the RIGHT address. Yet they were returned. Said address not known and unable to forward. I went to their website, no where on there do they list an address. They want you to purchase their report, and they tell you that the address is on the report.
so, I was wondering...what address did you mail your dispute to when you wrote Experian??
And did you send yours certified return receipt?

This was after I sent to another po box but the letter was forwarded from what I can tell. They got the information. This address is listed on the paperwork I got from experian. I didn't send via certfied mail to any of them and I haven't had any problems.

Got my FIRST new credit report from Bureau today (transunion), get this....its showing this account as PAID or paying as agreed. It was opened 8/1998 and was closed on 01/2000 date updated as 02/2000. This is the account that I have had sooooo much trouble with. I just sent wells fargo a letter last week, hope this doesn't open a can of worms. Its not showing as charge off or anything. shows as Paid or paying as agreed. I am sooooo confused people with the finding that I have found today. thanks shirley
