I received a letter today regarding a required collection 344.92 which this company says is Seriously Delinquent. The problem is in 1993 I was in the process of buying my first home and a Bally's fitness collection showed up on my credit report. I rectified the siuation by settling the dispute in 1993 and my credit report was fixed and so purchased my first home. I have perfect credit now and have since purchased my second home 4 years ago with no problems and a clean credit history. My problem is I cannot find proof of payment because this was almost 13 years ago and have since destroyed older records mor than 7 years old. This company is requesting payment asap. I know for a fact this collection was paid. I do not even know if my old mortgage company would have proof of the credit inquiry or if my bank would have proof of the cancelled check at this late time. Please help. I am very confused as to what to do. The very first line on this letter reads "This firm represents asset acceptance llc." The letter i received is from Bennett & DeLoney.


Hi, your account is surely past the SOL period. Moreover, you know that the account has been paid but you don't have any papers to prove it. In this situation, call the company whom you paid money regarding this account. Also, contact the credit bureau and request for a copy of your credit report of that period.

Send a letter to the collection agency and ask them to send you the details of the debt in writing. After you have received the information, place it on dispute. Send your letters certified with return receipt requested and keep copies of everything in your file.

You should also check your latest credit and see if this collection agency has entered anything in your file. They are only allowed to enter legitimate remarks in your file. Since this debt is out of the seven years reporting time, the company can't enter anything in your file. Practically speaking, there are no reasons this collection agency should appear in your file. If they are shown, strike back by disputing with them. They don't have legal reasons to take actions against you, so you don't have to worry about it. Keep disputing with them and stay away from them. Remember, you will have to send all your letters through certified mail. You should have copies of all the actions taken from your side.
