debt collection on old debts

can a debt collector try to collect a debt that is 12 years old..that has been written off


As SoapLady said, you do still owe the debt. They just cannot take legal action to compel you to pay it after the Statute of Limitations has run on it. Be advised that if you give them one thin dime towards it, you will reset the SoL, and they will be able to sue.

What sort of debt is this, and who's trying to collect? If it's still with the original creditor after all this time (possible, but highly doubtful), then you oughtta pay it on principle. If it's with a junk debt buyer (far more likely), I'd tell'em to pound sand, again on principle. My reasoning is that if the debt has been sold off to a JDB, then the OC has been paid. Anything you pay now will go straight to the JDB.

this debt is from efferson Capitol Systems,LLC they admit that this is a time-barred debt.. the SOL is for 5 years in my state.. they want to issue a credit card for the balance of 1100 dollars and and for me to make payments of the card ..do I send a cease and desist or a letter of validation.. or tell nice try but no deal if I am not wrong since the SOL has expired I am no longer leagally required to pay
