Well, if the creditor doesn't agree to the settlement offer made by the settlement firm, they may sue the defaulted customer as their last option to collect the debt. However, I still would have checked with the county court to see if there indeed is a pending lawsuit against me since collection companies often use fake summons to scare customers to pay. Anyway, since you have been served it's important for you to file an answer for it. Have you informed the settlement firm you're working with about the summon? IMO that is where you should start.

Good advice, thanks. I'm pretty sure the summons is authentic. One thing is that the law firm that filed the suit has sent me forms asking for a breakdown of my income and assets. I thought it would be crazy to volunteer that information. One thing that's frustrating is that I'd have taken the offer if I could have, It was just like blood from a stone. Things have gotten really tight in the past year. I can't say it was a bad deal on the outstanding balance.
Where can I find information on the best way to file an answer and what that entails? I hav'nt yet contacted the settlement firm. They explicitly state that they don't handle litigation. I will, though, hopefully they can provide some advice.
