multi DV request

Quick question....Just how many times can a CA (in this case lvnv) not validate a debt but keep passing it on. Before it is a violation?

Hi Unclewulf,
This is on my debts that I have been posting about. For instance, LVNV bought the debt from Allied, and tried to have Resurgent collect on it. So I sent validation to Allied, Resurgetn, and LVNV. I never received a validation from either, and then I get the letter from WWR, on Saturday. So that is why I asked the question.
I was just wondering how long this can go on, being passed to so many CA, via LVNV.

Have you DV'ed WW&R? Chances are that they can't produce either. Still, it never hurts to find out.

:cool:Update....I got a letter from Weltman,Weinburg & Reis today (good news) on this account that LVNV keeps passing around.
As stated above, I kept asking for DV each time it was given to another one of their companies, and I never received one (DV).
So when I got the letter of collection from WWR, I told them of the two times I had requested validation and with whom the request was made, and that I had been paying on this account faithfully with Allied until LVNV (supposedly) bought it from Allied.
So I get home today and have received the following letter, it goes like this:
Dear Ms____
Your request for verification of the above captioned debt had been received. However, we have returned this file to our client, and have ceased collection activities relative to the above captioned account. Therefore, we will not be able to assist you in obtaining the requested information.
This law firm is a debt collector that was attempting to collect this debt for our client, and any information obtained would have been used for that purpose, however, this file has been closed.
Sincerely,
Sarah Pinchot
verification representative.
This is listed on my credit report now as a disputed account and charged off by OC, (i received a copy from CSC credit service whoever they are, when I disputed this and another debt that I was paying on).
So now what? Should I just wait it out for another letter from one of LVNV's entities?
This is two Credit card companies now that show charged off and the JDB is listed as disputed on my report. So what happens now?
It is really sad it has went this far, when I was making payments to the OC and they sold it off.
At least I was trying.

Never, ever, admit anything to these people. Make them work for it, every step of the way. Don't even admit that the sky is blue, unless you have some serious reason for doing so.

Yeah, sure. They returned it to their client. More likely, LVNV yanked it back as soon as you showed some backbone. That's about their speed.

I think it's time for an ITS (Intent to Sue) letter, directed at both LVNV and the next creature they farm it out to. Include it with a DV, if appropriate, so you get double duty out of the postage.
In the ITS, state that you have them cold on multiple FDCPA violations. One for each time they farmed it, plus whatever else they've pulled. Add up the number of shells they've farmed it to, and multiply by $1,500. Then offer to settle the case with them for that amount and other considerations, like burying the account, 'to save them the embarassment and expense of legal proceedings.' FYI, you could only sue for $1,000. But you have to start someplace. Might as well aim high. You may or may not (probably not) get any $$$ out of them. But your real aim is to kick them squarely in the nuts and make them bury the account.
Caveat: This may well get you sued. No big, if it does. Because they're still going to have to validate in order to win. If they could've validated, they would have done so by now. And there's one thing for certain. If you don't put the boots to them, they'll either work up the courage to sue eventually, or they'll run you ragged for years. Your choice.

Thanks a bunch for all the help. I am going to send another letter to LVNV (certified) and let them know they are in violations, and also to the other JB who hasnt' verified but is still on my reports.

Re: Account No.
Dear Sir/ Madam
Recently I received collections letters on your behalf from Resurgent Capital and Weltman, Weinberg & Reis attempting to collect on the account number listed above.
According to the Fair Debt Practices Act (FDCPA), I have the right to claim a validation of the debt and you are obligated to provide me the relevant documentation. Request for the validation was sent via certified mail to both parties, but validation has never been received. Resurgent and WWR, have both retracted their claims to collect.
As of the date of this letter, your company is still listing this as a collection on my credit report, which is a violation of the FDCPA.
You are now in violation of the FDCPA, and subject to a fine of $1000.00 for each occurrence, which I may collect by filing a claim. I intend to continue with the suit if I don’t hear back from you within the coming 15 business days.
A copy of this letter is being sent to all three credit bureaus, the FTC, and the Indiana Attorney Generals office.
Sincerely

Just a minute here....... You DV'd WWR and Resurgent. Did you DV LVNV directly, as well? If not, you're going to need to either work a demand for validation into the letter I'm tweaking, or send one with it.

Under the Fair Debt Collection Practices Act (15 USC 1692), I have the right to validation of this alleged debt. You are obligated to provide me the relevant documentation. Request for the validation was sent via certified mail to both parties, and signed for on (__date__). To date, validation has not been received. Resurgent and WWR, have both retracted their claims to collect.
As of the date of this letter, your company is still listing this as a collection on my credit report in violation of the FDCPA. You are hereby notified that, unless you immediately remove this unvalidated account from my credit reports, I will have no choice but to pursue legal action against you. You are subject to damages in the amount of $1000.00 for each credit bureau you have reported this account to. You have thirty days from receipt of this letter to comply.

Change the address on the tweaked letter I posted. I was just working over the content. Never even looked at the address you were sending it to. If something for LVNV winds up in the offices of REsurgent, it'll likely go in the trash, or get returned to you.

Good Luck on your mess with LVNV!! Unc is right, if you show that you know what your rights are and stand up--they back off--they get po's, but they back off!!
I lost count of the agencies that LVNV sent me letters from. They final one I dealt with was WW&R--Finally a lady got on the phone and told me that she knew I was "debt educated" and what site I got my info from, and that it was wrong!! I told her it was about time I became debt educated!!
What I did was basically what Unc said, except at that time I didn't know it was called an intent to sue. I dv'd them again and then at the bottom of my letter I stated all the violations that I could think of that they have broken, and that I figured that they owed me xx amount for them and also that they owed in excess of 12,000 because of the one that was collecting(Sears) for, we had overpaid.I also sent some copies of letters of previous dvs that I sent them. Needless to say, I haven't heard from them in a while--knock on wood--and everything else!
Hang in there and let us know what happens and how things are going..karen

Not sure what the dig at Unc is all about. Also not sure what you meant by encouraging people into consignment.
We are all here, everyone, not just mods, to get help and give help.We give experiences or knowledge to help others decide what route to go. This may include Do it Yourself, Debt Consolidation,Debt settlement, student Loans, etc., or just may give support for what they are going through.
The mods or anyone else for that matter, do not profit from getting someone into settlement or consolidation. If they did. I would be better off financially than I am now after all these years!
If you will read, we earn points and anyone who becomes a member does.

Yeah, Unc,probably are the same age, or close. I think I still beat you though--Lol

OK, troll. Put down the crack pipe, and step away from it slowly.
